What the buyer wants

The application to the ÚOHS is subject to the submission of objections to the contracting authority, which must be delivered within 15 days of the date on which the complainant became aware of the alleged infringement of the law by the contracting authority, but at the latest until the conclusion of the contract or the time when the tender is deemed to be terminated after the selection of the application. Opposition against acts notified in documents which the procuring entity is required by law to publish or send to the complainant shall be served by the procuring entity within 15 days of its publication or delivery to the complainant. Where the procurement procedure provides for a time limit for the submission of requests to participate, objections to the conditions relating to the supplier's qualification shall be received by the contracting authority at the latest by the end of that period. Where the procurement procedure provides for a time limit for the submission of tenders, objections to the procurement conditions shall be notified to the contracting authority at the latest by the end of that period. Any objections to the content of the invitation to tender in the dynamic purchasing system or in the award of a contract under a framework agreement shall be received by the contracting authority at the latest by the end of the time limit for the submission of tenders. In the design contest, the opposition to the conditions of competition must be notified by the end of the deadline for the submission of the proposals at the latest. The contracting authority may provide in the procurement documents or in the conditions of competition that the opposition referred to in Article 242 (3) or (4) of the Act may be lodged not later than 72 hours before the expiry of the time limits referred to in Article 242 (3) or (4) of the Act. Any objections to the voluntary notification of the intention to conclude a contract pursuant to Article 212 (2) of the Act must be notified to the contracting authority within 30 days of the publication of that notice. The contracting authority shall be obliged to settle the objections within 15 days. The application shall be delivered to both the OOHS and the contracting authority within 10 days of the date on which the complainant received the decision by which the contracting authority refused the opposition or within 25 days of the dispatch of the objections, unless the contracting authority has decided on the opposition. Following the conclusion of a contract or framework agreement, only a proposal may be made to impose a prohibition on the performance of a contract, even without prior submission of objections. The application to impose a prohibition on the performance of a contract shall be submitted by the appellant of the ÚOHS and in a copy to the contracting authority within 30 days of the date on which the contracting authority published the contract notice in accordance with Article 212 (2) of the Law, stating the reason for the award of the contract without the publication of a contract notice, the advance notice or the invitation to tender in a simplified sub-restricted procedure, but not later than 6 months after the conclusion of the contract. The application to impose a prohibition on the performance of a contract pursuant to Article 254 (1) (d) of the Act shall be submitted by the appellant of the ÚOHS and in a copy to the contracting authority within 30 days of the date on which the contracting authority published the notice of the conclusion of the contract under the framework agreement pursuant to Article 137 of the Act or the notification of the conclusion of the contract in a dynamic purchasing system pursuant to Article 142 of the Act, but not later than 6 months after the conclusion of the contract.
