1. Lot 1Part 1

   The subject of the contract is: BUILDING AND SUPPLY OF DRUIGING DEVICES BY PART: CZ AND SUPPLIES AND DELIVERY OF XEROcopIER Purchase and delivery of the new photocopier, including installation, commissioning and training of employees in the field of operation of the ordered device – quantity: 8 pcs. The subject-matter of the contract is described in the annexes to the WWZ: a detailed description of the subject-matter of the contract and the proposed provisions of the contract. In cases where trade marks, patents, origin, source or specific process are indicated in the description of the subject-matter of the contract which characterises the products or services supplied by a particular Contractor, which would lead to favouring or eliminating certain Contractors or products, this means that the Contracting Authority cannot describe the subject-matter of the contract in a sufficiently precise and understandable manner and is justified by the specific nature of the subject-matter of the contract. In such cases, any indications on trade marks, patents, origin, source or specific process shall be read with the words ‘or equivalent’. Where the Contracting Authority describes the subject matter of the contract by reference to the standards, technical assessments, technical specifications and technical reference systems referred to in Article 101(1)(2) and (3) of the Code, The Contracting Authority shall allow equivalent solutions to be described and the references indicated above shall be read with the words ‘or equivalent’. Under the concept of equivalent solutions, the Ordering Party understands such equipment, which has technical and functional parameters which meet at least the conditions set out in the description of the contract. An economic operator who relies on solutions equivalent to those described by the Contracting Authority shall demonstrate in the offer that the proposed solutions meet the requirements set out in the detailed description of the subject matter of the contract to an equivalent extent.

   Przedmiotem zamówienia jest: ZAKUP I DOSTAWA URZĄDZEŃ DRUKUJĄCYCH Z PODZIAŁEM NA CZĘŚCI: CZ. II ZAKUP I DOSTAWA WIELOFUNKCYJNYCH URZĄDZEŃ DRUKUJĄCYCH Zakup i dostarczenie fabrycznie nowego wielofunkcyjnego urządzenia A3, wraz z instalacją, uruchomieniem i przeszkoleniem pracowników w zakresie obsługi zamawianego urządzenia – ilość: 4 szt. Przedmiot zamówienia został opisany w załącznikach do SWZ: szczegółowym opisie przedmiotu zamówienia oraz projektowanych postanowieniach umowy. W przypadkach, kiedy w opisie przedmiotu zamówienia wskazane zostały znaki towarowe, patenty, pochodzenie, źródło lub szczególny proces, który charakteryzuje produkty lub usługi dostarczane przez konkretnego Wykonawcę, co prowadziłoby do uprzywilejowania lub wyeliminowania niektórych Wykonawców lub produktów, oznacza to, że Zamawiający nie może opisać przedmiotu zamówienia w wystarczająco precyzyjny i zrozumiały sposób i jest to uzasadnione specyfiką przedmiotu zamówienia. W takich sytuacjach ewentualne wskazania na znaki towarowe, patenty, pochodzenie, źródło lub szczególny proces, należy odczytywać z wyrazami „lub równoważne”. W sytuacjach, kiedy Zamawiający opisuje przedmiot zamówienia poprzez odniesienie się do norm, ocen technicznych, specyfikacji technicznych i systemów referencji technicznych, o których mowa w art. 101 ust. 1 pkt 2 oraz ust. 3 Pzp, Zamawiający dopuszcza rozwiązania równoważne opisywanym, a wskazane powyżej odniesienia należy odczytywać z wyrazami „lub równoważne”. Pod pojęciem rozwiązań równoważnych Zamawiający rozumie taki sprzęt, który posiada parametry techniczne i funkcjonalne spełniające co najmniej warunki określone w opisie przedmiotu zamówienia. Wykonawca, który powołuje się na rozwiązania równoważne opisywanym przez Zamawiającego, jest obowiązany udowodnić w ofercie, że proponowane rozwiązania w równoważnym stopniu spełniają wymagania określone w szczegółowym opisie przedmiotu zamówienia.
