D/81/2026 Purchase and supply of server computing set for Artificial Intelligence applications (server + 2 monitors + accessories) – 1 pcs.

1. The subject of the order is: Purchase and delivery of server computing kit for Artificial Intelligence applications (server + 2 monitors + accessories) – 1 pc. 2. The description of the order is set out in Annex 1A to the WWZ. 3. Requirements concerning the subject matter of the order 3.1. The subject of the contract will be delivered to the Contractor at the risk of the Contractor and within the remuneration (as specified in the offer) of the Contractor. 3.2 As part of the proper performance of the subject-matter of the contract, the Contractor is obliged to deliver and submit a complete and assembled (on-the-spot installation) the subject-matter of the contract (with the parameters specified in the description of the subject-matter of the contract) to the premises indicated by the Contracting Authority within the time limit specified in point 4 of the SWZ. Where additional materials, components and equipment are required for the subject of the contract delivered The contractor shall be obliged to provide them with the remuneration specified in the tender. 3.3. The Contractor must offer the performance of the subject-matter of the contract in accordance with the requirements of the Contracting Authority set out in the EGM and the annexes and cover the entire scope of the contract. 3.4. All requirements set out in Annex 1A to the WWZ – Description of the subject matter of the contract are minimum requirements and are mandatory. Failure to comply with the above minimum requirements will result in rejection of the tender pursuant to Article 226(1)(5) of the Pzp Act as incompatible with the terms of the contract. 3.5. The subject matter of the contract must comply with the applicable requirements laid down in Regulation (EU) No 2023/98 of the European Parliament and of the Council of 10 May 2023 on general product safety, amending Regulation (EU) No 1025/2012 of the European Parliament and of the Council and Directive (EU) 2020/1828 of the European Parliament and of the Council and repealing Directive 2001/95/EC of the European Parliament and of the Council and Council Directive 87/357/EEC (OJ L 135, 23.05.2023, p. 1, as amended). 3.6. The contractor is obliged to supply the object of the order with a new, unused, unrefractory, non-regenerated, non-exposure-free, physical and legal defects, complete and in compliance with the requirements set out in the OGA. 3.7. Where trade marks, patents, origin, source or specific process characterising certain products or services are indicated in the description of the subject of the contract, this means that the Contracting Authority cannot describe the subject of the contract in a sufficiently precise and understandable manner and is justified by the specific nature of the subject matter of the contract. In such situations, the possible use of the above indications shall be read ‘or equivalent’. The Contracting Authority shall indicate in the description of the subject matter of the contract the criteria used to assess equivalence. 4. Warranty 4.1. The Contractor shall grant a guarantee of twenty-four [24] months for the subject of the contract. 4.2. The guarantee period referred to in point 4.1. is a minimum period. The contractor in the tender may take into account a longer warranty period for the object of the contract offered, but not more than sixty [60] months. Paragraph 19.2.2. SWI applies. 4.3. The warranty period for the subject-matter of the contract is calculated from the date of delivery of the subject-matter of the contract (confirmed by the receipt protocol). 5.1. The deadline for the performance of the subject-matter of the contract is fifteen [15] working days from the date of conclusion of the contract. 5.2. The time limit for the performance of the object of the contract referred to in point 5.1. is the maximum time limit for the performance of the object of the contract.
