Delivery of computer equipment for the premises of the Municipality of Malechowo

1. The subject of the order is the delivery of computer equipment for the needs of the Municipality of Malechowo. 2. The subject-matter of the order includes the supply of desktop computers (4 pcs) and multi-function devices (1 pcs) - the detailed description of the subject-matter of the contract is set out in Annex 2 to the SWZ. 3. The subject of the order should be delivered to the premises of the Ordering Party. 4. General requirements: 1) Unless otherwise indicated, any WWZ records containing technical parameters shall be read as minimum parameters. 2) The equipment supplied must be brand-new, unused, unregenerated, complete, produced not earlier than January 2025, free from any physical and legal defects, technically efficient, coming from the official distribution channel. The statement ‘factory new’ shall mean original packaging equipment (the packaging must be intact and have the manufacturer's security). A ‘physical defect’ shall also mean any non-compliance with the description of the subject matter of the contract. 3) The equipment must be equipped with all necessary equipment for its operation and to ensure the required functionality of the Hardware standard software solutions, together with the right for the Contracting Authority to use these solutions in such a function without delay, but in any case not less than the time it will be technically possible to use the Equipment. 4) The guarantee documents issued and transmitted by the Contractor should be in accordance with the provisions of the SWI. 5. The software will come from a legal, i.e. software accepted by the manufacturer of the distribution channel and will be made available to the Contracting Authority for use on terms applied or accepted by such manufacturer. 5. Criteria for equivalence: 1) In cases where trademarks, patents, origin, source or specific process are indicated in the description of the subject matter of the contract which characterises the products or services supplied by a particular Contractor, which would lead to favouring or eliminating certain economic operators or products, this means that the Contracting Authority cannot describe the subject matter by sufficiently precise terms and this is justified by the specificity of the subject matter of the contract. In such cases, any indications on trade marks, patents, origin, source or specific process shall be read with the words ‘or equivalent’. 2) In situations where the Contracting Authority describes the subject matter of the contract by referring to Polish or European standards, technical assessments, approvals, technical specifications and technical reference systems referred to in Article 101(5) of the PZP Act, The Contracting Authority shall allow equivalent solutions and the references indicated above shall be read with the words ‘or equivalent’. 3) Under the concept of equivalent solutions, the Ordering Party understands such equipment which has technical and/or functional parameters at least equal to those specified in the WWZ. An economic operator who relies on equivalent solutions described by the Contracting Authority shall demonstrate that the supplies or services offered by the Contracting Authority comply with the requirements laid down by the Contracting Authority.
