What the buyer wants

The subject of the order is the delivery of equipment and equipment to the Photographic Studio at the City Museum in Tychy with the following tasks: 1) TEST No 1 — Cameras (including accessories and warranty) 2. TEST No 2 — Lighting equipment (including accessories and warranty) 3) TEST NR 3 — Desktop and portable (including software, accessories, warranty and service) 4) TEST No 4 — Graphical programmes 5) TEST No 5 — Office furniture Detailed description of the order is given in Annex 4 to the SWZ. 1. Where the trade marks, patents or origin, source or specific process, which characterises the products or services provided by a particular contractor, is indicated in the documentation, the contracting authority shall permit the use of equivalent materials described. 2. In the case of a reference to standards, technical assessments, technical specifications and technical reference systems as referred to in Article 101(1)(2) and (3) of the PPA Act, the contracting authority shall allow solutions equivalent to those described. 3. An economic operator who invokes equivalent solutions shall demonstrate that the solution offered by him meets the requirements laid down by the contracting authority. In this case, the contractor shall attach documents confirming the equivalence of the solutions offered. The burden of proving equivalence lies with the contractor. The contractor shall demonstrate equivalence by any (reliable) means. Failure to demonstrate equivalence results in rejection of the tender as incompatible with the terms of the contract. 4. Where the contract documents indicate the trade marks, patents, producer or specific origin of the product, those headings shall be deemed to contain the words ‘or equivalent’. The Contracting Authority shall require that the supply offered, including all ICT products, ICT services and ICT processes used for the performance of the contract, both as principal elements and components, environmental elements of the provision of the service or accompanying solutions, does not include: 1) ICT products, ICT services or ICT processes identified in the recommendation referred to in Article 33(4) of the Law of 5 July 2018 on the national cybersecurity system, stating their negative impact on the fundamental interest of State security; 2) an ICT product of which the type has been defined in the decision to recognise the supplier as a high risk provider referred to in Article 67b(15) of that Act, or the ICT services or the ICT process referred to in that Decision. Failure to comply with this requirement results in the rejection of the tender pursuant to point 17 of Article 226(1) or point 19 of the PPO Act respectively.
