Delivery of equipment and software under the project “Cybersafe waterworks” implemented by the Water and Sewering Company Sp. z o.o. in Black

1. The subject of the contract is the delivery of equipment and software under the project “Cybersafe waterworks” implemented by the Water and Sewering Company Sp. z o.o. in Black under Action C3.1.1 “Cybersecurity - CyberPL” financed by the National Recovery and Enhancing Resistance Plan. The subject of the order consists of: 1) UTM (PWK seat) – 1 pc. 2) UTM (Cleaning Room) – 1 pc. 3) Server – 1 pc. 4) UPS - 1 pc. 5) NAS - 1 pc. 6) Wifi Access Point - 2 pc. 7) SIEM (Security Information and Event Management) – 1 pcs 8) EDR class system (antivirus software) – 1 pc. 9) Rack cabinet (PWK seat) – 1 pc. 10) Rack cabinet (Cleaning Room) – 1 pc. 11) Switche – 2 pcs. A detailed description of the order is given in Annex 9 to the SWZ. The description of the subject-matter of the contract shall include the minimum requirements to be met by the subject-matter of the contract offered. 2. This contract is co-financed by the ‘Cybersafe waterworks’ project under Action C3.1.1. Cybersecurity – CyberPL, funded from the National Recovery and Enhancing Immunity Plan. Grant competition entitled “Cybersafe waterworks” with number KPOD.05.10-CW.01-001/25. 3. The Contractor undertakes to provide the factory equipment new, unused, free from physical and legal defects and issue documentation concerning the delivered item of the order, e.g. certificates, certificates, certificates, certificates of conformity, instructions for use, etc. 4. The Contractor is obliged to carry out the subject of the contract in accordance with the principles and guidelines of the Contracting Authority, the provisions of the OGA and the draft contract. 5. The contractor must provide any equipment and elements that are necessary for the proper functioning of the whole at his own expense. Where, in the course of the performance of the subject-matter of the contract, it appears that any device, component and/or licence is missing, the absence of which will result in the malfunctioning of the entire subject-matter of the contract, The contractor will deliver them at his own expense. 6. The Contracting Authority allows the Contractor to apply solutions equivalent to solutions specified by the Contracting Authority. The contractor offering an equivalent solution to the described above is obliged to demonstrate (provide) equivalence with regard to the specified parameters, which must be no worse than the parameters indicated by the Contracting Authority - The Contractor must demonstrate (provide) that the proposed solution meets the requirements set out in the WGM and its annexes, in particular as regards parameters. 7. If any reference to a particular product, source, trademark, patent or origin or specific process which characterises the products or services supplied by a particular Contractor is included in the description of the subject matter of the contract, it should be assumed that the Contracting Authority has provided such a description indicating the type and allows the submission of equivalent tenders, in particular technical, performance, functional and quality parameters not worse than those given in the description of the subject matter of the contract. 8. At each request of the Contracting Authority, including before the commencement of the use of materials and equipment intended for use in the execution of this order, The Contractor shall provide the Contracting Authority with documents confirming their release to the market. 9. In case the Contractor fails to provide an equivalent solution The Contracting Authority shall consider that the Contractor will carry out the subject matter of the contract in accordance with the solutions indicated in the SWI and its annexes. 10. Warranty for the delivered item is at least 12 months. In case of a longer warranty offered by the manufacturer, the manufacturer's guarantee will apply.
