What the buyer wants
1. The subject of the order is the delivery of IT equipment for KWP in Łódź and subordinate units. A detailed description of the terms of the contract is set out in the model contract — Annex No 8 to the SWI. 2. The Contractor undertakes to provide the Contractor with the subject matter of the contract with functional and technical parameters consistent with the submitted offer and detailed description of the subject matter of the contract. 3. The Contractor undertakes to deliver the subject-matter of the contract in the quantities indicated on the tender form according to the part. 4. The Contractor undertakes to deliver the subject-matter of the contract on a one-off basis within the time limit set out in the tender form in Annex 1.1-.1.5 to the GAE. 5. The place of delivery will be the seat of the Contracting Authority of KWP in Łódź, ul. Lutomierska 108/112. Delivery will take place on working days from 8:30 to 24.00, and will end no later than 15.00. 6. Delivery includes the introduction of equipment to the premises indicated by the Customer. Uncarryed goods shall be considered undelivered. 7. The subject of the contract must be brand-new, complete, fault-free. 8. If the subject of the contract covers an ICT product, ICT service or ICT process, the contractor is obliged to offer only such ICT products, ICT services and ICT processes as at the date of the submission of the tenders: 1. are not indicated in the recommendation referred to in Article 33(4) of the Act of 5 July 2018 on a national cybersecurity system, stating that they have a negative impact on the fundamental interest of the security of the State; 2. do not include an ICT product, the type of which has been defined in the decision on the recognition of a supplier as a high risk provider as referred to in Article 67b(15) of the Act of 5 July 2018 on a national cybersecurity system, or an ICT service or ICT process as defined in that decision. 9. If the contractor offers ICT solutions, it must clearly identify any ICT solution offered, in particular by indicating: 1. the name of the solution, 2. manufacturer or supplier, 3rd type, model, version or other indication enabling its identification, 4th function performed in the performance of the order. 10. The lack of clear identification of the ICT solution offered is a burden on the contractor. In the event of doubt, the Contractor is required to demonstrate that the ICT solution is not included in the recommendations (Article 226(1)(17) Ppp) or in the decision to consider the supplier to be a high risk supplier (Article 226(1)(19) Ppp). 11. If it is apparent from the content of the tender, documents submitted with the offer or explanations of the contractor that the tender includes the solution referred to in points (1) or (2) of paragraph 1, the tender shall be rejected pursuant to Article 226(1), point (17) or point (19) of the Public Procurement Act. 1. Przedmiotem zamówienia jest dostawa sprzętu informatycznego dla KWP w Łodzi i jednostek podległych. 2. Zamawiający najpierw dokona badania i oceny ofert, a następnie dokona kwalifikacji podmiotowej wykonawcy, którego oferta została najwyżej oceniona, w zakresie braku podstaw wykluczenia oraz spełniania warunków udziału w postępowaniu (art. 139 ust. 1 uPzp). 3. W związku z zastosowaniem procedury z art. 139 ust. 1, Zamawiający nie wymaga złożenia wraz z ofertą oświadczenia, o którym mowa w art. 125 ust. 1uPzp. Zamawiający będzie żądał tego oświadczenia wyłącznie od wykonawcy, którego oferta zostanie najwyżej oceniona. 4. Na podstawie art. 257 pkt. 1 uPzp Zamawiający zastrzega możliwość unieważnienia postępowania. 5. Zamawiający nie przewiduje udzielania zamówień w trybie art. 214 ust. 1 uPzp. 6. Zamawiający nie przeprowadza wstępnych konsultacji rynkowych.
