Equipment for training with HMS C3IS JASMINE The subject of the order is the delivery of equipment of the workshop to implement trainings with HMS (Headquarters Management System) C3IS JASMINE. The description of the order is contained in Annex 2 to the SWZ. In cases where trade marks, patents, origin, source or specific process are indicated in the description of the subject-matter of the contract which characterises the products or services supplied by a particular Contractor, which would lead to favouring or eliminating certain Contractors or products, this means that the Contracting Authority cannot describe the subject-matter of the contract in a sufficiently precise and understandable manner and is justified by the specific nature of the subject-matter of the contract. In such cases, any indications on trade marks, patents, origin, source or specific process shall be read with the words ‘or equivalent’. The Contracting Authority shall not divide the contract into parts. The division of the contract into parts is not possible due to the specificity of the subject-matter of the contract, it constitutes a functional whole, the elements of which must be mutually compatible and provided simultaneously for the launch of the workshop. Thus, the Contracting Authority does not allow the submission of partial tenders as referred to in Article 7(15) of the Pzp Act. The Contractor shall carry out the contract on the terms and conditions described in the model contract annexed to the SWZ. The Contracting Authority may cancel the procurement procedure if the public financial means which the Contracting Authority intends to allocate to finance all or part of the contract are not granted to it, given that the possibility of cancelling the procedure on this basis is provided for in the contract notice (Article 257 of the Public Procurement Act).
