Provision of services of the WAN KSI ZUS wide network operator

1. The Contractor shall comply with the condition that it demonstrates that it carries out telecommunications activities concerning the subject matter of the contract on the basis of an entry in the Register of Telecommunications Entrepreneurs referred to in Article 10(1) of the Act of 16.07.2004. Telecommunications Law (i.e. OJ 2024 item 34, as amended), led by the President of the Office of Electronic Communications. Note 1: In the case of Contractors jointly applying for a contract, each Contractor who will perform a contract in the field of services which require registration in the Register of Telecommunications Entrepreneurs in accordance with the Act of 16.07.2004. Telecommunications law (i.e. Dz.U. 2024 item 34 as amended) must be entered in the Register of Telecommunications Entrepreneurs. 2. In order to confirm the fulfilment of the condition of participation in the procedure, the Contractor shall submit a confirmation of the entry in the register of regulated activities, i.e. a certificate of entry in the Register of Telecommunications Entrepreneurs referred to in Article 10(1) of the Act of 16.07.2004. Telecommunications law (i.e. Dz. U. 2024 item 34 as amended), confirming the operation of the subject of the order.

1. The contractor will meet the condition if it demonstrates that it has a creditworthiness or financial means of at least PLN 10 000 000,00. Note 2: In the case of Contractors jointly applying for a contract, the condition in question shall be deemed to be fulfilled if Contractors will jointly show creditworthiness or financial resources of at least PLN 10 000 000,00. Note 9: In cases where the Contractor has the capacity of other entities to confirm compliance with the condition of participation, the condition must meet a minimum of one of those entities. Note 10: The Contracting Authority shall convert the values given in a currency other than the Polish zloty at the average exchange rate of the NBP at the date on which the Contracting Authority transmits the contract notice. If the forwarding of a contract notice to the Publications Office of the European Union occurs on the date on which the NBP does not publish a table of average rates, The Contracting Authority shall make the conversion after the NBP medium course in force on the day following the date of notification of the notice to the Publications Office of the European Union. 2. In order to confirm the fulfilment of the condition of participation in the proceedings, the Contractor shall submit information to the bank or cooperative savings and credit institution confirming the amount of funds held or credit capacity of the Contractor, within a period not earlier than 3 months before its submission.

The Contracting Authority shall consider the condition to be satisfied if the Contractor demonstrates that during the last three years before the deadline for the submission of tenders and if the period of business is shorter, during that period, he has completed or duly performs the service of the WAN connection during a period of at least 12 consecutive months, within one or a maximum of two contracts for a total amount of at least PLN 6 000 000,00 gross. Note 3: The Contracting Authority shall consider the services provided as satisfying the above condition, if they were performed duly and continuously for a period of at least 12 consecutive months, before the deadline for the submission of tenders and the value of those services during the period shown - 12 months was at least PLN 6 000 000,00 gross. Note 4: In the case of a contract to confirm the above condition, which also included other benefits, The Contracting Authority shall require that the service of the WAN connection be performed on a continuous basis for a period of at least 12 months. Note 5: The Contracting Authority shall recognise the service provided for a full 12 consecutive months, e.g. from 1 February to 31 January of the following year. Note 6: If the Contractor uses the experience acquired on the basis of the services provided in the consortium, the Contractor may rely on the provision of such a service if he has actually and specifically participated in its implementation. Note 7: With regard to the conditions for experience, Contractors jointly applying for the award of a contract may rely on the capacity of those Contractors who have provided services to which those capacities are required. Note 8: In the case of Contractors jointly applying for a contract, the condition of participation in the procedure shall be deemed to be fulfilled if the condition is fulfilled in full by at least one of the Contractors jointly applying for a contract. Note 9: In cases where the Contractor has the capacity of other entities to confirm compliance with the condition of participation, the condition must meet a minimum of one of those entities. In order to confirm the fulfilment of the condition of participation in the proceedings, the Contractor shall submit a list of services performed or provided during the last 3 years before the deadline for the submission of tenders and, if the duration of the activity is shorter, during that period, in accordance with the design Annex 8 to the WWZ and the addition of evidence to determine whether these services have been performed or are duly performed; the evidence in question shall be references or other documents drawn up by the entity for which the services have been performed or are duly performed, and if the contractor for reasons beyond his control is unable to obtain these documents - the contractor's statement.
