Purchase and supply of interactive monitors for the needs of the University of Opole

1. Lot 1Zakup i dostawa monitora interaktywnego 75” do sali dydaktycznej Wydziału Filologicznego – 1 szt.

   1. The subject of the order is: Purchase and delivery of an interactive monitor 75" to the teaching room of the Faculty of Philology – 1 pc. 2. The description of the order is set out in Annex 1.1 to the WWZ. 3. The subject of the contract will be delivered to the Contractor at the risk of the Contractor and within the remuneration (as defined in the offer) of the Contractor. 4. The Contractor shall, in the context of the proper performance of the subject-matter of the contract, deliver and submit a complete and assembled (on-the-spot installation) the subject-matter of the contract (with the parameters specified in the description of the subject-matter of the contract) to the premises indicated by the Contracting Authority within the time limit specified in point 4 of the SWZ. Where additional materials, components and equipment are required for the subject of the contract delivered The contractor shall be obliged to provide them with the remuneration specified in the tender. 5. The Contractor must offer the performance of the subject of the contract in accordance with the requirements of the Contracting Authority as defined in the SWZ and the annexes and cover the entire scope of the contract. 6. The subject matter of the contract must meet all the requirements of a safe product in accordance with Regulation (EU) No 2023/98 of the European Parliament and of the Council of 10 May 2023 on general product safety, amending Regulation (EU) No 1025/2012 of the European Parliament and of the Council and Directive (EU) 2020/1828 of the European Parliament and of the Council and repealing Directive 2001/95/EC of the European Parliament and of the Council and Council Directive 87/357/EEC of 10 May 2023 (OJ L 135, p. 1). The contractor is obliged to deliver a new item (in particular unrepaired, unrefrigerated, unexposed, previously unused, in original, unopened packaging, if applicable) from current production and legal distribution channel, efficient, complete (in particular with all components, parts, materials) and compatible with the OGA, respectively. 7. In cases where trademarks, patents, origin, source or specific process characterising certain products or services would be indicated in the description of the subject of the contract, this means that the Contracting Authority cannot describe the subject of the contract in a sufficiently precise and understandable manner and this is justified by the specificity of the object of the contract. In such situations, the possible use of the above indications shall be read ‘or equivalent’. The Contracting Authority shall indicate in the description of the subject matter of the contract the criteria used to assess equivalence.

2. Lot 2Zakup i dostawa monitora interaktywnego 75” do sali 201 Wydziału Filologicznego - 1 szt.

   1. Przedmiotem zamówienia jest: Zakup i dostawa monitora interaktywnego 75” do sali 201 Wydziału Filologicznego - 1 szt. 2. Opis przedmiotu zamówienia stanowi załącznik nr 1.2 do SWZ. 3. Przedmiot zamówienia dostarczony będzie Zamawiającemu na ryzyko Wykonawcy i w ramach wynagrodzenia (określonego w ofercie) przysługującego Wykonawcy. 4. Wykonawca w ramach należytego wykonania przedmiotu zamówienia zobowiązany jest do dostarczenia oraz wniesienia kompletnego i zmontowanego (dopuszcza się montaż na miejscu) przedmiotu zamówienia (o parametrach określonych w opisie przedmiotu zamówienia) do wskazanego przez Zamawiającego pomieszczenia, w terminie określonym w pkt. 4 SWZ. Jeżeli dla dostarczonego przedmiotu zamówienia wymagane jest zapewnienie dodatkowych materiałów, elementów i sprzętu Wykonawca zobowiązany jest do ich zapewnienia w ramach wynagrodzenia określonego w ofercie. 5. Wykonawca musi zaoferować realizację przedmiotu zamówienia zgodnie z wymogami Zamawiającego określonymi w SWZ oraz załącznikach i objąć ofertą cały zakres przedmiotu zamówienia. 6. Przedmiot zamówienia musi spełniać wszystkie wymagania produktu bezpiecznego zgodnie z Rozporządzeniem Parlamentu Europejskiego i Rady (UE) 2023/988 z dnia 10 maja 2023 r. w sprawie ogólnego bezpieczeństwa produktów, zmieniające rozporządzenie Parlamentu Europejskiego i Rady (UE) nr 1025/2012 i dyrektywę Parlamentu Europejskiego i Rady (UE) 2020/1828 oraz uchylające dyrektywę 2001/95/WE Parlamentu Europejskiego i Rady i dyrektywę Rady 87/357/EWG z dnia 10 maja 2023 r. (Dz.Urz.UE.L Nr 135, str. 1). Wykonawca zobowiązany jest do dostarczenia fabrycznie nowego przedmiotu zamówienia (w szczególności nienaprawiany, nierefabrykowany, niepowystawowy, wcześniej nieużywany, w oryginalnym, nieotwieranym opakowaniu – jeśli dotyczy) pochodzącego z bieżącej produkcji oraz legalnego kanału dystrybucji, sprawnego, kompletnego (w szczególności ze wszystkimi podzespołami, częściami, materiałami) oraz zgodnego z OPZ – odpowiednio do części. 7. W przypadkach, kiedy w opisie przedmiotu zamówienia wskazane zostałyby znaki towarowe, patenty, pochodzenie, źródło lub szczególny proces, charakteryzujące określone produkty lub usługi, oznacza to, że Zamawiający nie może opisać przedmiotu zamówienia w wystarczająco precyzyjny i zrozumiały sposób i jest to uzasadnione specyfiką przedmiotu zamówienia. W takich sytuacjach ewentualne posłużenie się powyższymi wskazaniami, należy odczytywać z wyrazami „lub równoważny”. Zamawiający wskazuje w opisie przedmiotu zamówienia kryteria stosowane w celu oceny równoważności.
