Evidence of a form of registration under the law of the country of residence shall be provided confirming that the tenderer is not in any of the situations of cancellation of his constitution and that he has the professional capacity to perform the activities covered by the contract. Note: the document will be presented, through SEAP, in any form, signed with extended electronic signature based on a qualified certificate, according to Law No 214 / 2024. The information in the document submitted shall be real / valid on the date of its submission. For foreign legal / natural persons: In the case of bidders of non-Roman nationality, these documents will be submitted in the language of origin accompanied by an authorised translation of them in the Roman language. Edifying documents concerning the economic operator's activity (as provided for in Article 173 of Law No 98 / 2016, as amended and completed). Method of delivery: The Single European Procurement Document (DUAE) will be completed and the supporting document (ONRC certificate for Romanian economic operators, i.e. equivalent document issued in the country of residence for foreign bidders) will be submitted at the request of the contracting authority by the highest bidder in the ranking drawn up on completion of the evaluation of tenders. The documents will be presented in certified translation in Romanian. All documents requested by the contracting authority for the fulfilment of the DUAE shall be submitted by the tenderer by electronic means in SEAP, signed with extended electronic signature based on a qualified certificate, in accordance with Law No 214 / 2024 on electronic signature.

Information regarding experience over the last 3 years The economic operator must demonstrate that over the last 3 years, within one or more contracts, it has supplied similar products and provided similar services with a total cumulative value of at least RON 1,446,281.00 excluding VAT. Similar products and services will be considered: software solutions for data protection and security, hardware solutions for backup, network switch-type equipment, products representing local interconnection systems, integrated solutions for data and IT application protection, backup, replication, and recovery, solutions aimed at ensuring data security and integrity and transactions performed on categories of data managed at the IT systems level, solutions to increase resilience to ransomware attacks and other IT incidents, solutions to ensure the integrity and recoverability of backups, solutions to ensure continuity in case of site unavailability, solutions for automating protection processes and reducing dependence on manual interventions, etc. Clarifications: The last 3 years required for demonstrating similar experience will be calculated in relation to the deadline for the submission of tenders. If the contracting authority is forced, for whatever reason, to postpone the deadline established for the submission of tenders, publishing a corrigendum in this regard, the lower limit of the 3-year period is extended by the time period corresponding to the postponement, the requirement being considered fulfilled for all operators who submitted proof of completion of the similar experience contract within the newly resulting timeframe. The postponement of the deadline established for the submission of tenders and the resulting setting of a new date cannot automatically lead to the rejection of a tenderer on the grounds that its similar experience falls outside the 3-year period calculated relative to the new submission deadline, as long as the tenderer fulfilled the requirement as requested on the date originally established in the contract notice. In the event that the tenderer was established or commenced its economic activity less than 3 years ago, the presentation of information corresponding to the actual period of activity will be taken into account. Method of fulfillment: - The ESPD shall be completed. In the ESPD, the following information must be specified: the number and date of the contract invoked as similar experience, the contract value (expressed in RON without VAT), the beneficiary, the detailed subject matter, the delivery period, the date and number of the acceptance document/performance certificate, the tenderer's role in the contract, the share and/or activities for which it was responsible, the manner of fulfilling contractual obligations, and, if applicable, any damages. Relevant supporting documents will be requested as evidence: certificates/documents issued or countersigned by contracting authorities or private clients, beneficiaries of the deliveries, such as quantitative and qualitative acceptance reports, recommendations, or any other equivalent conclusive documents attesting to the actual delivery of the products listed in the ESPD. To demonstrate its capacity to deliver the products, the tenderer must prove that the delivered products were accepted and were/are functional. The supporting documents requested to prove the requirement shall be submitted by the economic operator ranked first in the intermediate ranking, upon request by the contracting authority. The contracting authority has the right to contact the final beneficiary of the products covered by the contract presented as experience to confirm the information presented by the tenderer.
