What the buyer wants

1. The subject of the contract is the renewal of the assistance and technical support for the software and equipment used by the Chief Inspectorate for Plant Protection and Seeding. 2. Detailed description of the subject matter of the order, is set out in Annex 1 to the SWZ - Description of the object of the order and Annex 2A to the WZ - Designed provisions of the contract. 3. The Contracting Authority is the Chief Inspectorate of Plant Protection and Seeds, Al. John Paul II 11, 00-828 Warsaw in the name and for which the Service Centre for Government Administration operates, ul. Powsińska 69/71, 02-903 Warsaw.

1. Przedmiotem zamówienia jest odnowienie asysty i wsparcia technicznego dla użytkowanego przez Główny Inspektorat Ochrony Roślin i Nasiennictwa oprogramowania oraz urządzeń, w podziale na 15 części. 2. Szczegółowy opis przedmiotu zamówienia, dla każdej części, został określony w Załączniku nr 1 do SWZ - Opis przedmiotu zamówienia oraz Załączniku nr 2A do SWZ - Projektowanych postanowieniach umowy. 3. Zamawiającym jest Główny Inspektorat Ochrony Roślin i Nasiennictwa, Al. Jana Pawła II 11, 00-828 Warszawa w imieniu i na rzecz którego działa Centrum Obsługi Administracji Rządowej, ul. Powsińska 69/71, 02-903 Warszawa. 4. Zamawiający nie przewiduje udzielania zamówień, o których mowa w art. 214 ust. 1 pkt 7 ustawy Pzp. 5. Zamawiający nie przewiduje przeprowadzenia aukcji elektronicznej, o której mowa w art. 227 - 238 ustawy Pzp. 6. Zamawiający nie dopuszcza składania ofert wariantowych w rozumieniu art. 92 pkt. 1 ustawy Pzp. 7. Zamawiający dopuszcza składanie ofert częściowych. Każdy Wykonawca ma prawo złożyć ofertę na jedną lub więcej części niniejszego postępowania, opisanych w Załączniku nr 1 do SWZ. 8. Zamawiający nie przewiduje zawarcia umowy ramowej, o której mowa w art. 311 – 315 ustawy Pzp. 9. Zamawiający nie przewiduje zwrotu kosztów udziału w postępowaniu. 10. Zamawiający nie dopuszcza złożenia ofert w postaci katalogów elektronicznych lub dołączenia katalogów elektronicznych do oferty. 11. Zamawiający może unieważnić postępowanie o udzielenie zamówienia, jeżeli środki, które Zamawiający zamierzał przeznaczyć na sfinansowanie całości lub części zamówienia, nie zostały mu przyznane, a możliwość unieważnienia postępowania na tej podstawie została przewidziana w ogłoszeniu o zamówieniu. 12. Zamawiający informuje, iż działając na podstawie art. 95 ust. 1 ustawy Prawo zamówień publicznych podjął decyzję o nienakładaniu na Wykonawcę lub podwykonawcę wymogu zatrudnienia na podstawie umowy o pracę osób wykonujących czynności w zakresie realizacji przedmiotowego zamówienia. Przedmiotem zamówienia są specjalistyczne usługi asysty technicznej oraz wsparcia producenta i autoryzowanych partnerów dla posiadanego przez Zamawiającego środowiska sprzętowo-programistycznego. Analiza charakteru czynności, które będą świadczone w ramach tej umowy, wskazuje, że nie wykazują one cech stosunku pracy w rozumieniu Kodeksu pracy - art. 22 § 1 ustawy z dnia 26 czerwca 1974 r.
