What the buyer wants
The winning tenderer's task is to provide server hosting services to the Contracting Authority for a period of 18 months up to a net framework budget of HUF 100,128,000, for 100 percent of which the Contracting Authority undertakes a drawdown obligation. High-standard technical placement of the Contracting Authority's server machines, provision of related technical and professional services. Ensuring uninterrupted operational conditions, a high-standard technical environment, and continuous high-bandwidth connectivity for servers and telecommunications equipment while continuously maintaining services. Data center requirements: The Contracting Authority's requirement regarding the data center is that it must possess a server room with at least TIER III or equivalent certification*. Power supply of the hosting area: For each rack cabinet, at least 2 IEC320 power distribution units and power outlets providing independent power feeds must be provided. Structural engineering: Provision of a floor slab/raised floor capable of supporting the total weight of a fully loaded (approx. 1,360 kg) standard (19”, 42U high (1970x600x1200)) rack cabinet. Fire protection, HVAC, power supply, utilities. Fire protection: Fire protection prescribed for electrical rooms. Sensors and automatic gas-based fire extinguishing system. Operational environment: Ensuring server room temperature complying with manufacturer specifications via a redundant air conditioning system maintaining at most 22 ± 2°C, which performs cooling from under the raised floor through the rack cabinets. Maximum humidity may be 50% (pursuant to MSZ EN 300 019-1-3:2003 Class 3.1: Temperature-controlled locations standard). Provision of fresh, filtered, dust-free air supply. The server room must provide protection against water damage. The ceiling slab, floor, and walls of the server room must be free of water and gas pipes. Lighting: Light intensity prescribed for office premises. Power supply: Power (high-voltage) and data communication (low-voltage) cabling of the rack cabinets is routed through the raised floor with a complete Cross Connect solution. Application of a cable management system: A system recording cable routes and labeling entering the building from outside and running within the building, which facilitates new installations and dismantling. Circuit breakers: Power supply per rack cabinet and per feed that can be properly interrupted (miniature circuit breaker or individual switch). Sub-meters: Redundant 3-phase power supply provided with separate sub-meters. The provision of power supply to cabinets must be arranged with separate sub-meters. Electricity fees are paid monthly by the Contracting Authority to the winning Tenderer based on actual consumption. Calculation of electricity consumption fee: Electricity consumption fee = Measured consumption * Electricity fee adjusted by cooling factor a.) Measured consumption: monthly consumption measured based on individual meter b.) Electricity fee adjusted by cooling factor (PUE - ratio of total data center power consumption to IT equipment power consumption). Uninterruptible power supply: Uninterruptible power supply system (understood to include generator and UPS). Security: • The server room must have 24/7 manned security service. • All entries and exits must be logged and must meet the facility and server room access protection requirements set by NIS2. • The server room must have a CCTV surveillance system. Recordings of the CCTV surveillance system concerning the Contracting Authority's area must be retained for the maximum 30 days specified in the relevant legislation, and the possibility of review must be provided upon request. • Entry is allowed only for pre-registered persons upon presenting photo and personal identification documents. • Autonomous entry of the Contracting Authority's personnel takes place according to the defined security rules. • 24/7 physical access to the server room must be ensured. • A…

§ 67 (1) - (2) Kbt and 321 / 2015 (X.30) In accordance with Article 1 (1) of the Corm. Regulation, a tenderer, where appropriate a capacity organisation, shall provide prior proof that he meets the competence requirements by submitting the EEKD. In this context, the applicant accepts the simple declaration of the economic operator concerned, i.e. section "Alpha 'of Part IV of the EEKD, not the rest. A separate form shall be required for each of the joint bidders and the declaration shall be made on behalf of the joint tenderers by the economic operator submitting the tender. An economic operator invited to submit certificates of competence requirements pursuant to § 69 (4) to (7) Kbt shall demonstrate that he meets the eligibility requirements as follows: M.1. For the Commission Pursuant to Article 21 (3) (i) of the Corm. Regulation, the applicant shall attach a signed description of the means, equipment or technical equipment available for performance stating: - location of the data centre, - relationship, - technical description of the data centre, and shall be accompanied by a complete ownership sheet or a valid lease contract, not older than 3 months as evidence of the existence of a link to the data centre (ownership / rental right) in simple copies. It is not necessary to attach a certified full ownership sheet, the applicant accepts the non-certified full ownership sheet copy. Compliance with the required competence requirement from the company-signed declaration should be clearly established. M.1. The applicant is unfit to have a data centre capable of providing a server hosting service that is owned or leased on a rented property, which has a climate-based system with a reserve unit and a redundant power supply system and a redundant internet connection. Data centre for server hosting services: minimum 6 sets of 19" size 42U high (1970 x 600x1200) rack cabinets. Air conditioning system with a spare unit: Reductive air conditioning system with a capacity of not more than 22 ± 2 ° and cooling from the base floor through the rack cabinets.

The applicant shall accept an equivalent certificate from an approved certification body (accredited in any national system) certifying compliance with the requirements of information security management systems, where the economic operator in question has not been able to obtain those certificates within the prescribed time limit for reasons which are not attributable to it, provided that the economic operator demonstrates that the proposed quality assurance measures comply with the required standards. M.2. The tenderer shall be unfit if he / she does not have an MSF ISO / IEC 27001 or equivalent (or equivalent quality assurance measures).

An economic operator invited to submit certificates of competence requirements pursuant to § 69 (4) to (7) Kbt shall demonstrate compliance with the competence requirements as follows: M.3 No 321 / 2015 (X.30) Art. 21 (3) of the Corm. regulation In accordance with point (c), equivalent documents from the recognised certification body (accredited in any national system) to demonstrate compliance with the Information Management Requirements for MSZ ISO / IEC 20000- 1: 2019 or equivalent certificate or other evidence of equivalent quality assurance measures or equivalent quality assurance measures (ISO 20000- 1: 2019) shall be included; the applicant shall accept an equivalent certificate from an organisation registered in another Member State of the European Union and other evidence of equivalent quality assurance measures, if the economic operator in question has not been able to obtain the proposed quality assurance measures within the time limit provided for by the proposed quality assurance measures. M.3 The tenderer shall be unfit if he / she does not have an MSF ISO / IEC 2000-1 or equivalent certificate (or equivalent quality assurance measures).
Pursuant to Section 67 (1)-(2) of the Public Procurement Act (Kbt.) and Section 1 (1) of Government Decree 321/2015 (X. 30.), the tenderer—or, where applicable, the capacity-providing entity—must preliminarily demonstrate compliance with the suitability criteria by submitting the ESPD. In this regard, the Contracting Authority accepts the simple declaration of the economic operator concerned, meaning that Part IV, Section "Alpha" of the ESPD must be filled out, and the remaining parts need not be. A separate form is required for each member of a group of economic operators (joint tenderers); the declaration on behalf of joint tenderers is made by the economic operator submitting the tender. Pursuant to Section 69 (4)-(7) of the Kbt., the economic operator called upon to submit certificates/evidence regarding the suitability criteria must verify compliance with the suitability criteria as follows: M.4. Pursuant to Section 21 (3) point a) of the Gov. Decree, presentation of its most significant services completed within the 3 years (36 months) preceding the dispatch of the contract notice, but commenced within at most 6 years (72 months), in the form specified in Section 22 of the Gov. Decree. The reference declaration or reference certificate must clearly show the fulfillment of all suitability criteria. The reference declaration or reference certificate must contain the following: - the subject matter of the service in sufficient detail to establish technical and professional suitability, - the time of performance (start and completion dates broken down at least by year/month), - the name of the other contracting party (former client), the name and contact details (telephone and/or email address) of the reference person, - the quantity of the previous service from which compliance with the suitability criterion can be established, - a declaration as to whether performance took place in accordance with regulations and the contract. Pursuant to Section 21/A of the Gov. Decree, the Contracting Authority is also obliged to accept certification of completed performances where, although a breach of contract occurred, the economic operator's liability for the breach of contract—undisputed by the other contracting party—does not exist. Pursuant to Section 22 (2) of the Gov. Decree, if performance was not carried out in accordance with the contract, the cause and extent of the deviation must be described in the certificate or declaration, as well as, in the event of a breach of contract by the economic operator, the fact of whether the economic operator is liable for the breach of contract. If the verification of suitability is performed by a declaration of the tenderer or another entity participating in verifying suitability, the declaration shall also include whether the other contracting party disputes the contractual compliance of the performance or—if declared by the economic operator—the circumstance that the economic operator bears no liability for the breach of contract. The reference declaration/reference certificate must be issued in such a way that the fulfillment of the suitability criteria can be verified from them. If the subject of the presented reference is broader than the subject of the public procurement, the sub-quantity or technical content relevant to the suitability criteria must be specified in the reference declaration/reference certificate. The Contracting Authority refers to the provisions set out in Section 21/A as well as Section 22 (1)-(2) and (5) of the Gov. Decree. M.4. The tenderer is unsuitable if it does not have a reference for providing server hosting services for a duration of at least 12 months provided in the 36 months calculated backwards from the dispatch of the contract notice (performances completed during this period but commenced within at most 72 months may be taken into account).
