1. The subject of the contract is the delivery of cyber infrastructure for Pelkom Sp. z o.o. in the technical area of IT and in the technical area of OT, which includes, inter alia, the purchase and implementation, i.e. installation and configuration, implementation, integration and commissioning, testing and optimization of equipment and software that is a cybernetic infrastructure that increases cyberattack resilience, as requested by the Contracting Authority in the National Recovery and Improvement Plan C3.1.1. Cybersecurity - CyberPL Recruitment No: KPOD.05.10-CW.01- 001/25 2. This project includes the implementation of a set of tasks together with the delivery of equipment and equipment with the relevant software - in accordance with the characteristics and requirements contained in the DESCRIPTION OF THE CONTRACT SUBJECT MATTER, which is Annex No 2 to the EGM. 3. The Contracting Authority requires that the acquisition, reproduction and dissemination of the software offered for the performance of the public contract in question should be without prejudice to the intellectual property rights of any third party and comply with the Act of 4 February 1994. – about copyright and related rights (Journal of Laws of 2025, item 24 as amended), by the Act of 30 June 2000. - Industrial Property Law (Journal of Laws of 2023, item 1170) and other applicable provisions of Polish law. The purchaser also requires that the certificates and labels of the software manufacturer attached to the offered software and other software components – are original and the software is new and never used before.
