The subject matter of the procurement covers the provision of 1 disk data storage array and 20 cassettes for a backup device. The performance requirements are described in detail in the Technical Specification of THE ADVANTAGE, Annex No 1. *** Implementing period: - The time limit for delivery of the equipment is 2 (two) months from the date of entry into force of the contract. - The period of warranty service (hardware guarantee, technical support and receiving new versions) shall be as proposed by the participant within the time limit set out in the offer, as from the date of the delivery protocol. - The acceptance and transmission of the implementation shall be carried out in accordance with the requirements of the contract. *** In case it is not a manufacturer, the participant should be authorised by the equipment manufacturer or by an official representative with distribution/delivery rights for the products offered in the Republic of Bulgaria. *** The requirement for authorisation at the stage of submission of tenders shall be justified by the subject-matter of the contract and shall constitute a guarantee of its timely and qualitative implementation. In the event that a contractor who is refused authorisation by the manufacturer is selected, this may result in a delay in the performance of the contract and its termination. According to the conclusions of the Supreme Administrative Court, the authorisation requirement is in itself not restrictive insofar as it guarantees the quality and reliability of the activity carried out. In normal commercial practice, authorisation shall be based on a contract which may be directly with the manufacturer or with another economic entity authorised to authorise on behalf of the manufacturer. (Decision No 10859 of 27.10.2021 of the SAC under Admiral No 6546/2021). In the documentation, the authorisation condition is extended, i.e. not limited to the manufacturer but also to any official representative of the manufacturer. A general authorisation is required, not for a specific procedure and an opportunity is provided for each interested participant - a partner, whether Bulgarian or foreign, to submit a tender, and an opportunity to prove the above fact is provided, both with a letter of approval and with any other equivalent document certifying compliance with the requirement.
