What the buyer wants
The purpose of this framework agreement is to acquire mobile phones, tablets and accessories reconditioned for the benefit of the Provence-Alpes-Côte d'Azur Region and the members of the Regional Purchasing Centre. The precise definition of the need is contained in the CCTV. The procurement procedure is an open invitation to tender (R. 2124-2, 1° of the public order code). It is a framework agreement within the meaning of articles R. 2162-2 et seq. of the Code of Public Order with an economic operator.
It is a contract reserved for suitable enterprises, establishments and services of support by labour and for integration by economic activity, in accordance with articles L. 2113-12, L. 2113-13 and L. 2113-14 of the Code of Public Order. The framework agreement sets out all the contractual provisions, it will be executed as orders are issued under the conditions set out in articles R. 2162-13 and R. 2162-14 of the public order code.
The framework agreement shall be concluded without a minimum amount and for a maximum annual amount of 100 000 euro(s) HT. The procedures for issuing purchase orders are set out in the CAPC. In accordance with Article L 2113-11 of the CCP, the choice not to grant this framework agreement is justified on the following grounds: - The purpose of the framework agreement does not permit the identification of separate benefits.
Reconditioned mobile phones and associated accessories constitute a homogeneous set of supplies designed to equip end-users. Their acquisition meets a unique need for equipment and renewal of mobile telephony equipment. - Devolution in separate lots is likely to restrict competition or could make it technically difficult or financially more costly to perform the services.
Indeed, the structure of the market in several lots would lead to the multiplication of the incumbents and contractual interfaces, at the expense of consistency of supplies, monitoring of guarantees, after-sales service and order management. The framework agreement is not divided. Alternatives are prohibited
