What the buyer wants
The bidders are bound by a one-man strategy (including options), unless an exception is expressly provided for in the specification. It is intended to conclude a framework agreement with up to three tenderers/groups of tenderers. The aim here is for the subsidised bidders/tendering associations to offer different manufacturers. For this reason, when tendering with the same manufacturer, the awarding authority will only take into account the best tender of the manufacturer concerned.
Therefore, if a manufacturer is offered by several bidders, only the best bid of the manufacturer concerned will be considered in the classification. All other offers with the same manufacturer are excluded. For the Los Headsets & UC audio peripheral, a value of 8.0 million will be added. EURO as the maximum call volume (maximum quantity, it is the gross value). The maximum call volume refers to all framework agreements concluded for the Los Headsets & UC audio peripheral.
If the maximum quantity for the Los Headsets & UC audio peripheral has been reached and an increase in the maximum quantity is not exceptionally permitted under § 132 GWB, no further individual orders can be placed. The individual calls resulting from the framework agreements shall be made as follows: the most favourable price of the individual call is decisive.
Exception: There are special requirements of the authorized subscriber, e.g. because he already has a stock of a certain manufacturer and products of another manufacturer would lead to additional effort (e.g. in training, the installation of software, etc.) or because only one manufacturer meets the requirements required by the authorized subscriber. There is no call obligation. No minimum purchase is guaranteed. More details are provided for in the framework agreement.
