What the buyer wants

The purpose of the procurement is to ensure the continuity of mobile phone hacking and efficient mobile data-saving devices and software in the NAV BF BIF Data Rescue Division. To this end, it is necessary to update the existing three Cellebrite 4PC, Cellebrite Inseyets online pro version, which is linked to the already existing Cell Inseyets software that expired on 2027-08-25. For this four data-saving software, an Unlock package, which replaces the current Premium system, is also available, which guarantees that 100 mobile devices per year are broken into Brute Force with all four software systems. The renewal and optimisation of the licensing environment in a single package is necessary due to the renewal of the expiry Cellebrite software used by NAV BF BITAF. The preliminary means of proof required in the tender, which is also necessary for the evaluation of tenders: pursuant to Section 67 (1) of the Kbt. (Public Procurement Act), the tenderer must submit the declaration contained in the ESPD in its tender. Pursuant to Section 2 (5) of the Kr. (Government Decree), the contracting authority requires that compliance with the minimum suitability criteria specified in the call for competition must be preliminarily verified by completing point α (alpha): 'Global indication for all selection criteria' in Part IV of the ESPD. The contracting authority does not require the provision of the detailed information listed in Part IV of the standard form. The verification of compliance with the suitability criteria will be conducted by the Contracting Authority in two rounds, pursuant to the provisions of Section 69 of the Kbt.: in the first round, it verifies the declaration made in the ESPD, and in the second round, the certificates to be submitted pursuant to Section 69 (4) of the Kbt. In the case of joint tendering, each of the joint tenderers must submit a separate ESPD. Means of proof required during evaluation (based on the contracting authority's request pursuant to Section 69 (4) of the Kbt.): REFERENCE: Suitability requirement: M1: The Tenderer is deemed unsuitable if it does not hold a reference, completed in accordance with the contract and the regulations during the three years (36 months) prior to the dispatch of the call for competition, concerning the performance of the delivery of at least 5 backup software licences. The Tenderer's suitability is also established by a reference relating to the delivery of new licences, licence renewals, or licence extensions. The tenderer may also satisfy the minimum suitability requirement across multiple contracts. The contracting authority will take into account deliveries completed during the period under examination, but commenced within a maximum of six years (72 months). The date of completion of performance shall be the date of issue of the certificate of completion. Means of proof: M.1: Pursuant to Section 21 (1) point a) of Government Decree 321/2015 (X. 30), the tenderer must present its deliveries corresponding to the subject-matter of the public procurement from the 3 years (36 months) preceding the dispatch of the call, certified in the form specified in Section 22 (1) of the Kr., i.e. by a declaration of the tenderer (or, where applicable, of another organisation participating in certifying suitability), or by a reference certificate issued by the other contracting party. The reference declaration or reference certificate must contain at least the following information: - name and address of the other contracting party; - the period of performance [by providing the start and end dates indicated with an accuracy of at least year-month (if necessary for examining the duration: year-month-day)]; - the subject-matter and quantity of the completed delivery, specified in sufficient detail so that compliance with the suitability requirement can be established [the specific delivered product must be indicated on the reference certificate/declaration, a generic designation is not sufficient]; - a declaration as to whether the performance was carried out in accordance with the regulations and the contract. If the performance was not carried out in accordance with the contract, the Tenderer must also describe the matters set forth in Section 22 (2) of the Kr. Pursuant to Section 21 (1) point a) of the Kr., if the contracting authority requires proof of performance over three years, the contracting authority shall take into account services completed during the period under examination, but commenced within a maximum of six years. Section 21/A of the Kr. shall apply.
