COMMUNICATION CONNECTION AND MAINTENANCE OF PROTECTED COMMUNICATION

The participant must be an enterprise that: 1. holds a valid authorization to use an individually assigned limited resource – radio frequency spectrum for the provision of electronic communications through public mobile terrestrial networks with national coverage, issued by the Communications Regulation Commission (CRC), and 2. holds an authorization to use an individually assigned limited resource – numbers for the provision of public electronic communications through a public electronic communications network, issued by the Communications Regulation Commission (CRC), and 3. is entered in the public register of enterprises having notified the CRC of their intention to provide public electronic communications – Public telephone services - Mobile telephone service pursuant to Art. 33, para. 1, item 1 of the Electronic Communications Act (ECA), and 4. is entered in the public register of enterprises having notified the CRC of their intention to provide public electronic communications – Data transmission – Internet access pursuant to Art. 33, para. 1, item 1 of the ECA, and 5. is entered in the public register of enterprises having notified the CRC of their intention to provide public electronic communications – Data transmission – Other data transmission services pursuant to Art. 33, para. 1, item 1 of the ECA. In the event that the participant is a foreign entity, it may submit a valid equivalent document or declaration, or certificate, issued by a competent authority of a European Union Member State, another State party to the Agreement on the European Economic Area, or the Swiss Confederation, proving the participant's registration in the relevant register of that state. If the participant is a consortium that is not a legal entity, compliance with the selection criterion shall be demonstrated by each of the entities included therein that will perform the respective activity, in accordance with the allocation of participants' involvement in the execution of the activities provided for in the document/agreement establishing the consortium, pursuant to Art. 59, para. 6 of the PPA. *IMPORTANT! The participant in the procedure must note that: The minimum requirement is demonstrated by providing details regarding the existence of registration pursuant to Art. 33, para. 1, item 1 of the Electronic Communications Act (ECA) and the existence of a valid authorization issued by the Communications Regulation Commission. When submitting a tender, information regarding the requirement shall be indicated by the participant in the ESPD. Pursuant to Art. 67, para. 5 of the PPA, the Contracting Authority may require participants at any time after opening the tenders to submit all or part of the documents proving the information stated in the ESPD, where this is necessary for the lawful award of the contract. In such cases, the requirement shall be proven by: • Authorization to use an individually assigned limited resource – radio frequency spectrum for the provision of electronic communications through public mobile terrestrial networks with national coverage, issued by the Communications Regulation Commission (CRC); • Authorization to use an individually assigned limited resource – numbers for the provision of public electronic communications through a public electronic communications network, issued by the CRC; • Certificate(s) issued by the CRC for entry in the Public Register of enterprises having notified the commission of their intention to provide public electronic communications (Art. 33, para. 1, item 1 of the ECA), according to the requirements of the Contracting Authority; or equivalent document(s) issued by the competent authorities of the country in which the participant is established, certifying the right to perform the respective activity. It is required that the participant in the procedure for the last three completed financial years has achieved a minimum total turnover of not less than EUR 900 000,00 excluding VAT calculated on the basis of the participant's annual turnover. When submitting a tender, the information on the requirement shall be indicated by the participant in the EEDOP. According to Art. 67, Paragraph 5 of the Public Procurement Act, the contracting authority may require the participants at any time after the opening of the tenders to submit all or part of the documents demonstrating the information specified in the EEDOP where necessary for the lawful award of the contract. In these cases, as well as when concluding a contract for the execution of the contract, compliance with the requirement shall be demonstrated by the presentation of: 1. certificates by banks or 2. the annual financial statements or components thereof where their publication is required under the legislation of the country in which the participant is established or 3. a reference to the total turnover (in free text). The information under item 2 and item 3 covers the last three completed financial years, and the information may also cover a shorter period depending on the date on which the participant was set up or started operating. Where for good reason a participant is unable to provide the documents requested by the contracting authority, it may prove its economic and financial situation by means of any other document which the contracting authority considers appropriate.

It is required that the participant in the procedure, for the last 3 (three) years from the date of submission of the tender, has carried out an activity (s) with an object identical or similar to that of the contract, namely to have carried out a construction and/or maintenance service for a communication system (s) or a solution (s) in the country, and/or equivalent ones outside the country. * The participant in the procedure must bear in mind that: An activity shall be deemed to have been carried out where a document is drawn up and signed, certifying the accepted execution issued by the person who entrusted it, or by indicating a public register in which information on its implementation is published! When submitting a tender, the information on the requirement shall be indicated by the participant in the EEDOP. According to Art. 67, Paragraph 5 of the Public Procurement Act, the contracting authority may require the participants at any time after the opening of the tenders to submit all or part of the documents demonstrating the information specified in the EEDOP where necessary for the lawful award of the contract. In such cases, as well as when concluding a contract for the performance of the contract, compliance with the requirement shall be demonstrated by the presentation of: List of services which are identical or similar to the subject-matter of the contract, accompanied by an indication of the values, dates and recipients, together with documents demonstrating the service performed.

The participant in the procedure is required to apply a quality management system certified according to EN ISO 9001:2015 standard (or equivalent certificate issued by authorities established in other Member States) with a range of activities (s) to provide and/or support for communication (s) and/or electronic communications service (s). * In completing the EEDOP, the participant in the procedure must bear in mind that: The provision of art. 64, para 5, para 6, para 7 and para 8 of the ZOP is in force! When submitting a tender, the information on the requirement shall be indicated by the participant in the EEDOP. According to Art. 67, Paragraph 5 of the Public Procurement Act, the contracting authority may require the participants at any time after the opening of the tenders to submit all or part of the documents demonstrating the information specified in the EEDOP where necessary for the lawful award of the contract. In such cases, as well as when concluding a contract for the performance of the contract, compliance with the requirement shall be demonstrated by the presentation of: Valid certificate (s) issued by accredited persons for quality control certifying compliance with the relevant standard. The participant designated as a contractor shall have a valid certificate (s) throughout the duration of the contract and, where applicable, apply equivalent measures.

The participant in the procedure is required to have staff and/or management with certain professional competence for the performance of the contract, including at least: Expert to provide management/management activities of the project. Professional area (qualification): have a valid project management certificate such as PMP (PMI project management certificate) and/or PRINCE 2 or equivalent. Specific experience: experience as head of a minimum of 1 (one) project related to the construction and/or maintenance of a communication system (s) or solution (s). B) Expert to provide security activities Professional area (qualification): have a valid CIE certificate (Certified Internetwork Expert) Security or equivalent. Specific experience: experience in carrying out network security activities in a minimum of 1 (one) project related to the construction and/or maintenance of a communication system (s) or solution (s). C) Experts to ensure information and communication technology activities Professional area (qualification): have a valid CIE certificate or equivalent; Specific experience: experience in implementing information and communication technology activities in a minimum of 1 (one) project related to the construction and/or maintenance of a communication system (s) or solution (s). D) Experts to secure maintenance activities of equipment Professional area (qualification): have a valid CNP certificate (Certified Network Professional) or equivalent; Specific experience: experience as experts providing equipment maintenance activities in a minimum of 1 (one) project related to the construction and/or maintenance of a communication system (s) or solution (s). * The participant in the procedure must bear in mind that: A natural person may perform the functions of only one expert in one participant's offer! When submitting a tender, the information on the requirement shall be indicated by the participant in the EEDOP. According to Art. 67, Paragraph 5 of the Public Procurement Act, the contracting authority may require the participants at any time after the opening of the tenders to submit all or part of the documents demonstrating the information specified in the EEDOP where necessary for the lawful award of the contract. In such cases, as well as when concluding a contract for the performance of the contract, compliance with the requirement shall be demonstrated by the presentation of: List of staff to perform the contract and/or of the members of the management staff responsible for the performance and documents demonstrating the professional competence of the persons.
