What the buyer wants
* * In accordance with Belgian public procurement regulations, the contracting authority has the option, at any stage of the award procedure, to exclude a candidate/tenderer who has been convicted by a final criminal judgment of an offence affecting their professional integrity. Non-compliance with criminally sanctionable environmental and social legislation may be deemed an offence affecting professional integrity.
As soon as this is established in a final judgment or ruling, it may be used as a ground for exclusion, regardless of the stage of the procedure.
Social legislation includes, inter alia: - the Decree of 10 July 2008 establishing a framework for the Flemish equal opportunities and equal treatment policy; the Act of 10 May 2007 combating certain forms of discrimination, the Act of 10 May 2007 amending the Act of 30 July 1981 criminalising certain acts inspired by racism or xenophobia, and the Act of 10 May 2007 combating discrimination between women and men; - the Act of 4 August 1996 on the well-being of workers in the performance of their work, specifically Chapter Vbis.
Special provisions on violence, harassment and sexual harassment at work. * By submitting a tender for this contract, the tenderer declares that it is not in an exclusion situation, as referred to in Articles 67 to 69 of the Public Procurement Act of 17 June 2016. Article 70 of the Public Procurement Act of 17 June 2016 applies.
For the grounds for exclusion referred to in Article 67 of the Act, the candidate or tenderer shall, on its own initiative, indicate whether it has taken the corrective measures referred to in Article 70(1) at the start of the procedure.
