- O udzielenie zamówienia mogą ubiegać się Wykonawcy, którzy:
- nie podlegają wykluczeniu w okolicznościach, o których mowa w art. 108 ust. 1 ustawy Pzp z zastrzeżeniem art. 110 ust. 2 oraz art. 109 ust. 1 pkt 4 ustawy Pzp, a także nie podlegają wykluczeniu na podstawie art. 7 ust. 1 ustawy z dnia 13 kwietnia 2022 r. o szczególnych rozwiązaniach w zakresie przeciwdziałania wspieraniu agresji na Ukrainę oraz służących ochronie bezpieczeństwa narodowego (t.j. Dz.U. z 2025 r. poz. 514);
- spełniają warunki udziału w postępowaniu dotyczące:
- zdolności do występowania w obrocie gospodarczym - Zamawiający nie stawia warunku w tym zakresie,
- uprawnień do prowadzenia określonej działalności gospodarczej lub zawodowej, o ile wynika to z odrębnych przepisów - Zamawiający nie stawia warunku w tym zakresie,
- sytuacji ekonomicznej lub finansowej - Zamawiający nie stawia warunku w tym zakresie,
- zdolności technicznej lub zawodowej - Wykonawca spełni warunek dotyczący zdolności technicznej lub zawodowej, jeżeli wykaże, że w okresie ostatnich trzech lat przed upływem terminu składania ofert, a jeżeli okres prowadzenia działalności jest krótszy – w tym okresie, należycie wykonał, a w przypadku świadczeń powtarzających się lub ciągłych wykonuje co najmniej dwie dostawy przełączników sieciowych o wartości nie mniejszej niż 250 000,00 złotych brutto każda.
- W przypadku składania oferty wspólnej, żaden z Wykonawców nie może podlegać wykluczeniu z postępowania.
- W przypadku składania oferty wspólnej warunek dotyczący zdolności technicznej lub zawodowej Wykonawcy mogą spełniać łącznie.
- W odniesieniu do Wykonawcy, który powołuje się na zasoby innych podmiotów, warunek musi być wykazany w zakresie w jakim Wykonawca powołuje się na ich zasoby.
