With regard to the contractor's experience, the condition will be met if the contractor demonstrates that he has experience in the form of proper performance over the last 3 years before the deadline for the submission of tenders, and if the period of business is shorter, during that period at least one contract involving the delivery and implementation of an enterprise-class system for monitoring IT infrastructure with a contract value of not less than PLN 100,00 gross. Contractors jointly applying for a contract shall fulfil the conditions for participation in the procedure concerning technical or professional capacity in the area of the contractor's experience together. When assessing technical or professional capacity, The contracting authority may, at any stage of the procedure, consider that the contractor does not have the required capacity if the contractor has conflicting interests, in particular the involvement of technical or professional resources of the contractor in other economic activities of the contractor may adversely affect the performance of the contract. To confirm compliance with the technical or professional capacity condition, The Contracting Authority shall require that, in accordance with the model set out in Annex 6 to the SWZ, the list of supplies and services performed and, in the case of repeated or continuous benefits, also carried out during the last 3 years, and if the duration of the activity is shorter, within that period, together with the value, subject matter, dates of performance and entities for which the supplies and services have been carried out or are carried out, and the addition of evidence indicating whether those supplies and services have been carried out or are carried out duly, with the evidence referred to, the references or other documents drawn up by the entity for which the supplies and services have been carried out, and in the case of recurrent or continuous services being carried out, and if the contractor is unable to obtain such documents, the contractor's statement; in the case of services which are repeated or continue to be performed, or other documents supporting their duly performed, should be issued within the last 3 months. Where the contractor cites experience in the delivery of supplies and services performed jointly with other economic operators, the list of supplies referred to above shall concern supplies and services in which the contractor has directly participated. The contractor may rely on the technical or professional capacity of the entities making the resources available, irrespective of the legal nature of the legal relationship between him and him, in order to confirm that the conditions laid down in Article 118 of the UPP are met. The economic operator, which relies on the capacity of the entities making the resources available, shall, together with the offer, require the entity making the resources available to it to carry out the necessary resources for the performance of the contract (made in accordance with the model set out in Annex 5 to the SGM) or any other body-based evidence proving that the contractor will have the necessary resources for the performance of the contract. The list of personal evidence requested by the Contracting Authority to confirm the condition of participation in the procedure is contained in the procurement documents available on the website of the tender procedure. The Contractor may, instead of the relevant body of evidence, submit a certificate confirming the certification of public procurement contractors in the scope referred to in Article 3(2)(1) or (2) of the Certification Act respectively.
