6. DESCRIPTION OF THE SUBJECT OF THE CONTRACT\ 6.1.1. Delivery to the Headquarters of the General Directorate for National Roads and Motorways - ul. Wronia 53, 00-874 Warsaw, and implementation, within up to 21 working days from the date of conclusion of the contract, of software licenses from Commvault Systems Inc. held by the Contracting Authority: 1) 30 Commvault Backup & Recovery For Unstructured Data licenses, Per Front-End Terabyte, Perpetual, product number CV-UBKRC-FT, 2) 30 Commvault Cloud Backup & Recovery Software for Virtual Machines licenses, Per VM (10-Pack), product number CV-BKRC-VM10, 3) 5,000 licenses - Commvault Cloud Backup & Recovery Software for Active Directory Enterprise, Per User, Perpetual, product number CV-ADE-USR - or the aforementioned quantities of "equivalent" software licenses within the meaning of Annex No. 1 to the Description of the Subject of the Contract (OPZ), constituting Volume III of the SWZ. 6.1.2. Support service, provided directly by the manufacturer - Commvault Systems Inc.* / the manufacturer of equivalent software* or indirectly through its authorized representative, for GDDKiA, regarding the maintenance of the consolidated backup and archiving environment of Commvault software* / equivalent software*, for a period of 21 months from the date of signing the license acceptance protocol, for the delivered Commvault licenses referred to in point 1.1 above* or equivalent licenses*. (*- if applicable) 6.1.3. As part of this contract, the Contractor undertakes to provide the Contracting Authority with training vouchers for four employees of the Contracting Authority in the field of "Architecture: Role of v11 platform components and methods of their implementation". The training vouchers are intended to enable the Contracting Authority's employees to participate in a 5-day open training course concluded with a certified exam. The Contracting Authority requires the training to be conducted in Polish by qualified specialists who are employees of the manufacturer, or by an authorized training center in Poland. The training vouchers should be made available to the Contracting Authority within 30 days from the conclusion of the contract and be valid for 21 months from the date of the training voucher acceptance protocol. The schedule of available training courses and their locations will be presented by the Contractor to the Contracting Authority in the first month of the contract term. The Contracting Authority permits conducting the training remotely. If the Contractor offers "equivalent" licenses, it is required to select the training (vouchers) option for equivalent licenses in the Price Form (Form 4.1). Detailed requirements regarding training related to the offered equivalent licenses are specified in point 12 of Annex No. 1 to the Description of the Subject of the Contract (OPZ), constituting Volume III of the SWZ. The provisions of the third to sixth sentences above shall apply accordingly. The Contracting Authority anticipates the possibility of awarding to the existing contractor of the basic contract a single-source public contract for additional deliveries of backup software licenses, as referred to in Article 214(1)(8) of the Public Procurement Law, with a value not exceeding PLN 813,008.13 net. 6.8. Pursuant to Article 5k of Council Regulation (EU) No 833/2014 of 31 July 2014 concerning restrictive measures in view of Russia's actions destabilising the situation in Ukraine (OJ EU L 229, 31.7.2014, p. 1, as amended), it is prohibited to award or continue the execution of any public contract with subcontractors, suppliers, or entities on whose capacity reliance is placed within the meaning of Directive 2014/24/EU where they account for more than 10% of the contract value.
