Delivery of IT hardware in two lots for the city of Schwelm

The city of Schwelm procures IT hardware in two lots. Lot 1 comprises 18 locations for network, video recording, access and power supply with UniFi according to the specification of services. Lot 2 includes 60 all-in-one PCs, 20 notebooks with a 16-inch display and ten convertibles with a 360-degree hinge and a built-in LTE or 5G module, as well as a suitable bag and a USB-C dock for the 30 mobile devices. The devices are to be supplied with Windows 11 Pro and the equipment described in the LV. The object is exclusively the hardware delivery including required licenses and accessories, without installation, commissioning or configuration.

3. Review clause The city of Schwelm reserves pursuant to § 132 Abs. 2 No 1 iVm. 132 par. 2 No. 4a GWB or according to § 132 Abs. 2 no. 1 GWB accordingly, in the order of the tender result, propose the performance of the services of suitable tenderers who have submitted an economically acceptable tender in the procurement procedure, if the contractor is definitively cancelled due to termination or another reason.In the event that the tender winner is finally cancelled before full service provision due to termination, insolvency or any other reason, the client reserves the right to submit the remaining works to the other tenderers in the order of the tender result up to place 5. The resulting additional costs are to be borne by the previous contractor from the point of view of the replacement.This only applies if the resulting increase in the total price is within the scope of § 132 Abs. 3 GWB within a given framework. Defensive Clause These Additional Conditions of Contract apply exclusively. Conflicting or deviating from these General Terms and Conditions of Contract shall only be accepted by the City of Schwelm if the City of Schwelm expressly and in writing agrees to the validity.These Additional Contractual Conditions also apply if the City of Schwelm accepts the delivery without reservation or pays the delivery in the knowledge of conflicting or deviating from these Additional Contractual Conditions.
