Development, implementation, maintenance, technical support and operational services for the ROCT platform

Economic operators submitting tenders must prove a form of registration under the law of the country of residence, showing that they are legally constituted, that they are not in any of the situations of annulment of the constitution and that they have the professional capacity to carry out the activities covered by the contract. Method of fulfilment: the DUAE will be completed by the economic operators participating in the award procedure with information related to their situation.

The supporting documents proving the fulfilment of those declared, i.e. the finding certificate issued by the ONRC or, in the case of foreign bidders, equivalent documents issued in the country of residence, are to be submitted, at the request of the contracting authority only by the highest bidder in the ranking drawn up on completion of the evaluation of tenders. The main and secondary activity (if any) and the relevant CAEN codes must be derived from the certificate.

The information in the finding certificate shall be real / valid at the date of its submission. The subject matter of the contract must be corresponding in the CAEN codes (main and / or secondary activities) entered in the certificate and must be authorised in accordance with the provisions of Article 122 (7) and (9) of Law No 265 / 2022 on the register of trade and for amending and supplementing other normative acts affecting the registration in the register of trade.

Foreign legal entities will present documents in translation authorized in Romanian. The document will have to be presented by both the tenderer and the associate tenderer, if any.

As preliminary evidence for demonstrating the fulfilment of this minimum qualification requirement, the tenderer (the individual economic operator or Association of Economic Operators) shall submit a completed and signed declaration of its own responsibility. The self-declaration is represented by the DUAE (reply).

The economic operator intends to subcontract possibly the following part (i.e. percentage) of the contract...." The information on the party / parties that the tenderer intends to subcontract will be included in the DUAE, together with which the Subcontracting Agreement will be submitted.

The tenderer shall at least submit the Subcontracting Agreement / Agreements with the economic operator / economic operators who perform / perform the role of Third Party Supporter to demonstrate the minimum requirement for relevant professional experience in relation to the main services provided accordingly. The contracting authority may request any economic operator involved in the procedure at any time during the evaluation process to provide evidence of the information completed in the DUAE (reply).

In the context of this procurement, similar services shall mean the provision of development services and / or the implementation and / or modernisation / extension of software applications, IT platforms or integrated IT systems.

The tenderer shall demonstrate a similar experience that can be demonstrated as follows: Provision of similar services: The tenderer (economic operator or members of the association together) must provide proof that over the last 3 years you report on the limit date fixed for the submission of tenders, he has provided similar services in the aggregate value of at least 786,776,86 lei (excluding VAT) of one - maximum 3 contracts.

As preliminary evidence for the verification of technical and professional capacity, the tenderer (individual tenderer, each member of an Association or Support Party) shall submit a declaration on his own responsibility. The self-declaration is represented by the DUAE (reply).

The DUAE shall be completed where the "a: Global indication for all selection criteria" of "Part IV: Selection criteria." The supporting documents to be submitted at the request of the Contracting Authority: Following an express request from the Contracting Authority and prior to the award of the public contract / framework agreement, the tenderer (individual tenderer or Association of Economic Operators) ranked first after applying the award criterion to submit updated supporting documents demonstrating that all qualification criteria have been met, in accordance with the information contained in the DUAE (reply).

The requirement to submit updated supporting documents shall apply to all Economic Operators connected with the Tenderer in this procedure (members of the Association, Third Supporters), if applicable. The supporting documents (nominated by the offeror in the DUAE (reply) and to be submitted by the tenderer who is the first to complete the evaluation process) considered appropriate for the demonstration of the information included in the DUAE (reply) include, but are not limited to:

1. Copies of relevant parts of the contracts they have performed; certificates / PV of surrender - receipt; Reception minutes; Establishing certificates / Recommendations / invoices, attesting that the service supplies have been carried out in accordance with the relevant legal rules and that the following information has been carried out and / or other documents showing the minimum: the beneficiary, the quantity, the period (including the date of conclusion of the contract) and the place of supply of the services)
2. b) any other evidence nominated by the tenderer in the DUAE (reply) as supporting documents for supplies of goods duly delivered that meet the minimum requirement. The contracting authority may request any economic operator involved in the procedure at any time during the evaluation process to provide evidence of the information completed in the DUAE (reply).The contracting authority reserves the right to request information directly from the competent authorities where there are uncertainties about the fulfilment of the minimum technical and / or professional capacity requirement (s) declared by the tenderer.
