- Economic operators submitting a tender must prove a form of registration under the law of their country of residence, demonstrating that the economic operator is legally established, is not in any situation leading to the annulment of its establishment, and has the professional capacity to carry out the activities that are the subject of the public procurement contract.
This requirement also applies to subcontractors for the portion of the contract they will perform, who shall fill in the information regarding their situation in a separate ESPD. In the case of tenders submitted by foreign legal entities, they shall submit any conclusive document in accordance with the legal requirements of the country in which the economic operator is established.
Method of fulfillment: Initially, economic operators will complete the ESPD; subsequently, the economic operator ranked first after applying the award criterion will submit the supporting document proving the fulfillment of the commitments made by completing the ESPD, namely the certificate of status issued by the National Trade Register Office (ONRC), or in the case of foreign legal/natural entities, the equivalent documents issued in the country of residence, translated into Romanian, are to be submitted, upon request of the Contracting Authority, only by the tenderer ranked first in the ranking drawn up after applying the award criterion.
