Economic operators submitting the tender must prove a form of registration under the law of the country of residence, showing that the economic operator is legally constituted, that it is not in any of the situations of cancellation of its constitution, and that it has the professional capacity to carry out the activities covered by the contract. For legal persons of Romanian nationality, the certificate of establishment issued by the National Office of the Trade Register must show that the main / secondary activity carried out according to the CAEN coding corresponds to the subject matter of the contract. Method of preliminary execution:

• As preliminary evidence, the DUAE will be provided by the single tenderer and, where appropriate, the associated tenderers, the supporting third party / third parties and the subcontractor.
• The supporting document is the finding certificate issued by the National Trade Registry Office, valid at the time of presentation, resulting in the correlation between the professional activity capacity and the subject matter of the contract.
• The purpose of the requirement is to confirm that the tenderer is not in any of the situations of annulment of his constitution and that he has the professional ability to perform the activities covered by the contract. Legal persons:
• They may present equivalent documents issued in accordance with the applicable law in the country of residence, translated and certified in Romanian.
• In the case of an association, each member of the association will present relevant documents for the part of the contract he will carry out. It is sufficient that each member's activity is consistent with the part of the contract he will perform.
• The supporting documents proving the fulfilment of those undertaken by completing the DUAE on beneficial ownership (i.e. the finding certificate issued by the ONRC or equivalent documents for foreign bidders / self-declaration on beneficial ownership for situations where there are no or cannot be issued documentary evidence) will be submitted only by the highest bidder in the intermediate ranking drawn up upon completion of the evaluation of tenders, at the request of the contracting authority.

Tenderers must demonstrate that, over the past 3 years, calculated by reference to the deadline for the submission of tenders, they have supplied and, as applicable, installed/configured equipment that is similar or superior in terms of technical complexity and/or intended use, under at least one contract or at most three contracts, with a cumulative value of at least RON 200,000, excluding VAT.

Similar equipment is understood to mean equipment intended for carrying out printing, deposition, and/or controlled layer formation processes of functional materials, pastes, inks, or other materials on various types of substrates, used in fields such as microelectronics, sensor technology, microsystems, advanced materials, semiconductors, surface engineering, or other comparable technical-scientific fields.

The supply of equipment falling within the categories or typologies described above, as well as equipment that is similar or superior in terms of technical and/or functional complexity and/or intended use, shall be accepted as similar experience, without being required to use the same technology or have the same configuration as the equipment subject to this procurement. If the deadline is postponed (via corrigendum), the 3-year period shall be extended accordingly.

The requirement is also deemed fulfilled for tenderers who qualified initially, even if their experience subsequently falls outside the new timeframe. For economic operators established or active for <3 years, only the actual period of activity shall be taken into account. Means of fulfillment: The ESPD shall be completed. Contracts performed as: sole contractor, consortium member, or subcontractor are accepted. The ESPD must contain:

• Number and date of the invoked contract
• Value (RON, excluding VAT)
• Beneficiary
• Type of equipment delivered/installed
• Role in the contract
• Share/undertaken activities
• Manner of fulfilling obligations and any damages Supporting documents (certificates, recommendations, acceptance documents, etc.) issued by public/private beneficiaries must be attached, accompanied by an authorized translation (if they are in another language). If third-party support is invoked (pursuant to Art. 182 of Law 98/2016), the third party must demonstrate compliance with the requirement through:
• Firm commitment
• Documents demonstrating the actual manner of support
• Annexes to the commitment
• If the tenderer is a joint venture/consortium, the requirement can be fulfilled cumulatively. Relevant documents for similar experience:
• Recommendations
• Certificates of satisfactory execution
• Documents regarding contractual obligations
• Final acceptances/receptions These must contain:
• Beneficiary
• Type of equipment
• Contract performance period Subcontracting: Information regarding the subcontracted part(s) and identification details of the subcontractors (if known) must be submitted. The tenderer's liability is not diminished if it uses subcontractors. Means of fulfillment: The information shall be included in the ESPD. If relying on the capabilities of subcontractors, an individual ESPD completed and signed for each must be submitted. The subcontracting agreement shall be submitted together with the ESPD. Subcontractors:
• shall specify in the ESPD information regarding the capabilities made available
• if not relied upon for capacity, shall only submit the ESPD confirming the absence of grounds for exclusion. Pursuant to Art. 196 para. (2) of Law 98/2016, only the first-ranked tenderer shall submit updated supporting documents upon request by the contracting authority.Third-party support: Technical/professional capacity may be supported by third parties, in accordance with the provisions of Art. 182 of Law No. 98/2016, as subsequently amended and supplemented (regardless of the nature of the legal relationship).
