M/1. Pursuant to Section 21(3)(a) of Gov. Dec. 321/2015 (X. 30.), the tenderer must describe its services according to the subject of the public procurement (support for the Neptun system) performed within three years (36 months) counted back from the dispatch of the contract notice, verified in accordance with Section 22 of Gov. Dec. 321/2015 (X. 30.). The reference declaration/certificate is also acceptable if the performance was completed within 3 years counted back from the date of dispatch of the notice, but the start date falls within 6 years. Unsuitability: The Tenderer is unsuitable if, in the aggregate of the 3 years counted back from the dispatch of the contract notice, it does not have a reference the subject of which is the support service of the student information system of at least one higher education institution, for a period of at least 1 academic semester in higher education. The reference certificate or declaration shall contain at least the following information: the period of performance (start and end dates), the name and contact details of the other contracting party, its subject matter in sufficient detail to demonstrate compliance, and a declaration must be made stating whether the performance was carried out in accordance with regulations and the contract. If the reference presented also contains data on services outside the scope of this procurement, a breakdown of the reference is required that clearly separates the performance corresponding to the subject of the procurement (Government Decree 321/2015 (X. 30.) Section 21/A). In the case of submitting a certificate, if the tenderer cannot attach a certificate with such content, it must make a separate declaration regarding the separated content. If the performance was not carried out in accordance with the contract, the reason for and extent of the discrepancy must be described in the certificate or declaration, as well as, in the event of a breach of contract by the economic operator, the fact of whether the tenderer's liability for breach of contract exists. If the suitability is verified by the tenderer's declaration, the declaration shall also include whether the other contracting party disputes the contractual compliance of the performance or the circumstance that the economic operator's liability for breach of contract does not exist. Preliminary verification of technical and professional suitability: Method of verification: Regarding the suitability condition, the tenderer must preliminarily verify compliance with the prescribed suitability condition pursuant to Section 67(1)-(2) of the PPA and Section 1(1) of Government Decree 321/2015 (X. 30.) by submitting the European Single Procurement Document (hereinafter: ESPD). The Contracting Authority accepts the simple declaration of the economic operator concerned – by completing point α of Part IV – without requesting detailed information during the preliminary verification by completing the European Single Procurement Document. If a tenderer wishes to comply with the prescribed suitability requirements by relying on the capacities of another organization or person pursuant to Section 67(3) of the PPA, the ESPD must be submitted separately for each of the organizations or persons concerned /Gov. Dec. 321/2015 (X. 30.) Section 3(2)/; and the tenderer must submit in the tender the declaration under Section 65(12) on behalf of the organization providing capacity /PD Annex 1/.
