Non-data transmission telecommunications services

In advance certification with EEKD, in accordance with § 67 (1) to (3), § 1 (1) and § 2 (5) Kr., AK shall accept the simple declaration of the economic operator (AT, capacity-providing organisation), without providing detailed information, by completing section α (alpha) of Part IV of the EEKD.

AK, prior to taking a decision on the outcome of the procedure pursuant to § 69 (4) to (7) Kbt, in the light of the assessment criteria, calls upon the most favourable ATO to demonstrate the following eligibility criteria by setting an appropriate deadline. (M1) In the light of Article 65 (1) (b) of the Kbt, the tenderer must provide for a period of three years (36 months) from the date of dispatch of the invitation to tender pursuant to Article 21 (3) (a) Kr.

Within 6 years (72 months), it started with a reference to the provision of services that fit the subject of public procurement (non-data transmission telecommunications services). Method of verification: Submission of a reference declaration or certificate, which shall include at least:

• the object and quantity of the contract (so as to clearly identify the fulfilment of the required minimum eligibility requirement);
• the name of the other party concluding the contract;
• the date of completion (starting and ending date (year / month / day), and a declaration of compliance with the requirements and the contract. Where the performance has not been carried out in accordance with the contract, the reasons and the extent of the derogation in the certificate or declaration and, in the event of a breach of the contract, the fact that the economic operator is liable for breach of contract shall be explained.The reference shall be certified in accordance with § 22 (1) to (2) Kr. The applicant refers to § 21 / A Kr and § 21 (3a) (a) Kr. AK draws attention to § 41 / A (1), (4) to (5), § 65 (7), (9), (11) to (12), § 67 (3), § 69 (11) to (11a), paragraph 14.(M1) Contracting authorities shall not be eligible if they do not have a reference to the provision of at least 25 non-transmission telecommunications services provided at different equipment addresses, completed in 3 years (36 months) from the date of dispatch of the invitation to tender (up to a maximum of 6 years (72 months). The above reference requirement may be met by one or more contracts.
