Operation of Gigabit network in Betzenweiler

OEW Breitband GmbH (OEW BB) has been commissioned by the Municipality of Betzenweiler to tender the network operation in the passive fiber-optic network to be constructed within the municipal territory on its behalf. The Municipality of Betzenweiler, located in the district of Biberach, is constructing a passive fiber-optic network under the federal government's broadband funding program using the operator model to provide approximately 770 residents with future-proof broadband connections.

The passive fiber-optic infrastructure built for this purpose is to be leased to a network operator. The scope of this tender covers exclusively address points whose development is carried out via the DGF program. The tender for planning services is currently being prepared, with publication scheduled by the end of 2026. The construction tender is expected to be carried out in the summer of 2027, with commissioning expected at the end of 2028.

The Municipality of Betzenweiler, as the Contracting Authority (AG), does not provide network operation services or internet and telecommunications services itself. The subject of this tender is therefore the leasing of a passive fiber-optic network to a service provider that, acting as the Contractor (AN) under a service concession, ensures network operation and provides internet and telecommunications services, also as a bundled offering, to residential and commercial end users for a reasonable fee.

In addition, the AN is responsible, among other things, for offering active as well as passive wholesale products to interested parties, taking into account the BMDS wholesale pricing information dated 31 March 2026 (see Annex). This is complemented by maintenance, servicing, repair, fault clearance, and support services, as well as associated services. The passive infrastructure of the AG will be transferred to the AN by way of lease on the basis of a corresponding network operation and lease agreement. The AN is an operator of a public telecommunications network pursuant to the Telecommunications Act (TKG) and has the following main tasks:

• Equipping the network with active technology, including any ONT required at the customer's premises;
• Operating the network in compliance with the SLAs provided by the AN;
• Providing and marketing internet and voice communication services to the public in accordance with Section 3, Item 55 TKG, also as a bundled offering of both services for residential and commercial end customers;
• Customer care for residential and commercial end customers;
• Providing both active and passive wholesale products to interested parties;
• Maintenance, repair, and servicing of the leased asset within agreed or specified service levels;
• Documenting all expansions and modifications of the leased asset in accordance with the GIS ancillary provisions applicable at the time of handover;
• Ensuring (reciprocal) open access with any network operator operating in the municipality, possibly within the WFP;
• Providing route and line information to authorized requesting parties. The right of use of the passive infrastructure belongs to the AG. Furthermore, the AG is generally the owner of the local passive infrastructure. This generally also applies to the fiber-optic backbone network.
