Private cloud computing

The Contractor shall demonstrate that he has duly completed within the last 3 years from the date on which the time limit for the submission of tenders expires, and if the period of business is shorter, within that period, at least 2 (two) contracts (contracts) the subject of which included: 1.1. the provision of subscriptions or the granting of licences for the use of a private cloud based on a container solution* and 1.2. ensuring that the manufacturer's technical support (maintenance) is provided for a period of at least 12 months and that the value of each contract (contract) is at least PLN 300 000,00 gross for the provision of a private cloud based on a container solution* and that the manufacturer's technical support (maintenance) is provided for a period of 12 months**. * By container solution, the purchaser understands an IT environment that allows to isolate, run and manage applications in containers. The container solution provides a coherent and standardised implementation environment for applications, regardless of the environment in which they are launched and managed from one central point. ** Where the value of the contract is expressed in a currency other than in Polish zlotys, The Contracting Authority shall convert the value of the completed contract in another currency into Polish gold – on the basis of the average rate of gold in relation to the foreign currency specified in the Table of National Courses of the Bank of Poland, which shall apply at the date of publication of the notice of the contract in the Official Journal of the European Union. 2. In order to confirm the fulfilment of the condition of participation, the Contracting Authority shall require the submission of a list of supplies or services performed and, in the case of services which are repeated or continuously performed, within the last 3 years from the date on which the time limit for the submission of tenders expires and, if the period of business is shorter, within that period, including the value, subject matter, dates of performance and entities for which the supplies or services have been carried out or are carried out, and the addition of evidence indicating whether those supplies or services have been performed or are duly performed, with the evidence referred to, with references or other documents drawn up by the entity for which the supplies or services have been carried out, and in the case of services which are repeated or continuous, and where the contractor is unable to obtain such documents, the contractor's declaration; in the case of benefits which are repeated or continued references or other supporting documents are duly performed, they should be issued within the last 3 months. 3. Article 117(3) of the Act shall apply to Contractors jointly applying for the award of contracts, taking into account Article 117(4) of the Act. 4. An economic operator may rely on the technical or professional capacity of the entities making the resources available, irrespective of the legal nature of the legal relationship between them, to confirm that the conditions for participation in the procedure are met. In that case, the Contractor shall submit the obligation referred to in Article 118(3) and (4) of the Act with the offer. 5. Pursuant to Article 112(3) of the Act, The Contracting Authority shall not apply the capacity levels specified in the provisions issued pursuant to Article 5(4) or (5) of the Act of 5 August 2025 on the certification of public procurement contractors (Journal of Laws of 2025 item 1235 as amended), since for the subject of the contract referred to in this SWZ, the capacity levels have not been specified.
