Procurement of data center IT services

In its offer to the tenderer, the proposal of 321 / 2015 (X-30) In accordance with Chapter II Kr., the Single European Procurement Document (EEKD) shall provide prior proof that it meets the competence requirements laid down in Section 65 of Kbt by completing Section IV of the EEKD. Certificates of competence shall be submitted at the request of the applicant, as provided for in § 69 (4) to (6) Kbt, pursuant to order 424 / 2017 (XII. 19). M / 1: A 321 / 2015 (X-30) Article 21 (3) (a) of the Corm.

Regulation requires the submission of the most significant performance of the invitation to tender, as provided for in Article 69 (4) to (6) of the Kbt., during the three years (36 months) after the return of the invitation to tender, in accordance with Article 69 (4) to (6) of the Kbt. In accordance with Article 21 (A) (22) (2) of Regulation No 816 / 2008, the date of completion (start and end, year / month / day), the reference subject (short description, quantity of content of the service, so that compliance with the minimum eligibility requirements can be established), − the name of the other party (name and contact details of the reference), − the declaration of compliance and compliance with the contract. the contracting authority shall accept proof as proof of performance if the result or activity contained in the reference requirement has been achieved as part of the contract.

The contracting authority shall also accept evidence of the performance achieved where, although there has been a breach of contract, the economic operator's liability for breach of contract, not contested by the other party to the contract, does not exist. The contracting authority shall not specify in the procurement documents an additional set of infringements by which it accepts proof of the performance concerned, provided that the performance required in the reference requirement has been achieved.

Joint Contracting Parties may meet the required competence requirements. In the EEKD, it is sufficient to state that it meets the required competence requirements by completing Part IV (α). The applicant draws attention to Article 24 (1) of the Korm Regulation. Contracting entities may comply with the required competence requirement while complying with § 65 (6) - (7) and (11) Kbt. As regards the proof of suitability, the provisions of § 22 (1) to (2) Kr. 21 / A apply.

When using § 65 (6) - (7) of the Kbt., we draw the attention of AT to § 67 (3) Kbt. and the corresponding application of § 3 (2) to (3) Kr. § 67 (3) Kbt. the organisation providing capacity shall demonstrate compliance with the eligibility criteria in the same way as the required certification methods.

In addition to what is stated here, the applicant does not wish to accept and determine the scope of the breach of contract with which the proof of the performance concerned is overaccepted by Article 21 / A. Minimum eligibility requirement (s): M / 1: The tenderer is unfit for performance of the contract if he does not have a reference completed in three years after the date of dispatch of the call for competition but started within a maximum of six years, covering at least 1 virtual server service from a data centre in Hungary for at least 12 months, with a value of at least 50 million HUF.

M / 2.1: Tender for 321 / 2015 (X-30) In accordance with Article 21 (3) (c) to (d) of Regulation No Korm, provide the ISO / IEC 27001: 2022 or MSZ ISO / IEC 27001: 2023 certificate or a copy of an equivalent certificate from an organisation accredited in any Member State of the European Union, or a copy of an equivalent certificate from an organisation registered in another EU Member State, or proof of the action of another equivalent information security management system.

It shall apply to the verification of competence in § 65 (6), (7), (11) and (12) of the Kbt. § 67 (3). The applicant's requirement under point M.2.1 is stricter than the list of qualified tenderers. In the case of joint applications, pursuant to Article 65 (6) of the Kbt., the eligibility requirement under point M3 is sufficient if one of the joint tenderers fulfils the conditions.

The tenderer shall be unfit if he does not have an ISO / IEC 27001: 2022 or MSZ ISO / IEC 27001: 2023 certificate or equivalent certificate from an organisation accredited in any Member State of the European Union or an equivalent certificate or other equivalent quality assurance measure from an organisation registered in another EU Member State. M / 2.2.

Tender for 321 / 2015 (X-30) In accordance with Article 21 (3) (c) to (d) of Regulation No Korm, provide the ISO / IEC 20000 Information Services Management Management System Certificate or a copy of an equivalent certificate from an organisation accredited in any Member State of the European Union, or a copy of an equivalent certificate from an organisation registered in another EU Member State, or proof of the action of another equivalent information security management system.

The tenderer shall be unfit if he does not have an ISO / IEC 20000 IT service management management system certificate or equivalent certificate from an organisation accredited in any Member State of the European Union or an equivalent certificate or other equivalent quality assurance measure from an organisation registered in another EU Member State. M / 2.3. Tender for 321 / 2015 (X-30) Under Article 21 (3) (c) to (d) of the Corm.

Regulation, please provide the certificate / certificate of the official document registrant certificate issued by the Internet Service Provider Council (ISST) Nonprofit Ltd) or equivalent certificate issued by the national or international organisation for the operation of domain registration systems.

The tenderer is unfit if he does not have the official domain registrant rating (accreditation) in force, or an equivalent rating / licence issued by a national or international organisation for the operation of domain registration systems.

M / 3. Tender, having regard to § 65 (1) (b) Kbt., No 321 / 2015 (X. 30) In accordance with Article 21 (3) (b) of the Korm Regulation, describe the names, qualifications and qualifications of the professionals to be involved in the performance.

Method of certification: Preliminary attestation: Pursuant to Article 1 (1) of the Korm.Regulation, the tenderer's tender must, in accordance with Chapter II of the Korm.Regulation, demonstrate in advance that he meets the eligibility criteria set by the contracting authority by submitting the ESPD.

The applicant accepts a simple declaration of economic operators pursuant to Article 2 (5) of the Korm.Regulation (The applicant must complete Section IV of the ESPD, not further sections of Part IV (A-D)). § 69 (4) and (6) Kbt. on the basis of a decision on the outcome of the procedure, the applicant may be considered the most favourable in view of the assessment criteria, or - § 69 (6) Kbt. According to its decision, the following number of most favourable Contracting Parties in the order of assessment shall be invited to submit the following declaration (s) or certificate (s): M.3. a simple copy of the documents demonstrating the qualifications of the professionals; the CV and availability signed by the experts and the statement that they are aware of their involvement in the proceedings.

The tenderer is unfit if he does not have: - at least one of the main professionals with an ITILV4 (i.e. Information Technology Infrastructure Library version 4) or equivalent education.
