Procurement of Oracle software maintenance and repair services in the N.SIS România infrastructure

Evidence will be provided of a form of registration under the law of the country of residence, confirming that the tenderer (tenderer, associate and subcontractor) is not in any of the situations of cancellation of its constitution and that it has the professional capacity to perform the activities covered by the contract. Method of accomplishment.

The Single European Procurement Document (DUAE) will be completed and the supporting document (ONRC certificate for Romanian economic operators, i.e. equivalent document issued in the country of residence for foreign bidders) will be submitted at the request of the contracting authority by the highest bidder in the ranking drawn up on completion of the evaluation of tenders. The documents will be presented in certified translation in Romanian.

All documents requested by the contracting authority for the fulfilment of the DUAE shall be submitted by the tenderer by electronic means in SEAP, signed with extended electronic signature based on a qualified certificate, in accordance with Law No 214 / 2024 on electronic signature.

Industrial security opinion SSV - TIP I - in accordance with Annex 2 to the specification Derulating the contract of, maintenance and technical support for the maintenance of oracle software products in the infrastructure N.SIS "implies access of representatives / personnel of economic operators to classified information of the Ministry of Internal Affairs (M.A.I.) / National SIS Centre (C.N.SIS).

The classified classified information in paper / electronic format, which is the subject of contractual activities, will be managed by the duly authorised staff of the provider / contractor (leader, associate, contractor, subcontractor) throughout the contract period, exclusively in the administrative areas of C.N.SIS Bucharest (both premises), while respecting the legal provisions of the field of protection of classified information.

Only authorised representatives of the economic operator may participate in the procedure for the award / conduct of the secret service contract, for which the D.G.P.I. issued the Security Decisions necessary for the economic operator to issue authorisations for access to secret service information and security certificates.

In order to participate in the procedure for the award of the classified secret service contract, the economic operator shall submit a written request to the contracting authority (at the premises of Domnita Anastasia, no. 2-4, sector 5, Bucharest, contact person Tudor Cristian, tel. [phone]) for the issuance by D.G.P.I. of the industrial security opinion SSV - TIP I, in accordance with the provisions of Article 17 of the Annex to O.M.A.I.

No 125 / 2020, to which the following documents are attached: (a) the industrial security questionnaire, according to the rules of O.M.A.I.

Method of implementation: The tenderers will initially mention in Duae that they submitted within the time limit set at the level of the Award Documentation the request to obtain the Industrial Security Opinion and will upload in Seap the evidence of the application, under the heading" Qualification Documents "to the economic operator (leader, associate, contractor, subcontractor), will be requested to submit the Industrial Security Opinion during the evaluation phase of the supporting documents for the performance of the DUAE requested to the highest bidder in the ranking drawn up on completion of the tender evaluation.

If, following the checks carried out, the DGPI does not issue to the applicant economic operator the industrial security notice, that offer shall be declared unacceptable, as provided for in Article 137 (2) (b) of GD No 395 / 2016.

The minimum annual average turnover of the tenderer over the last 3 years, 2023, 2024, 2025, must be at least 7.438.016,53 lei without VAT.

If a group of economic operators submits a joint offer, then the economic and financial situation shall be demonstrated by taking into account the resources of all members of the group with the application of Article 31 (3) of the Annex to Government Decision No 395 / 2016 for the approval of the methodological rules for the application of the provisions relating to the award of the public contract of Law No 98 / 2016 on public procurement, as amended and supplemented.

For the conversion of lei / other currencies the average annual rate communicated by the ECB for that year (2023, 2024, 2025) will be used. Method of implementation: Initially, the DUAE will be completed and at the request of the contracting authority, the highest bidder will submit supporting documents.

Financial statements or balance sheets of financial years shall be presented for the last 3 financial years (2023, 2024, 2025) covered by the authority where they were deposited or submitted to the vessel attesting the deposit by electronic means.

The tenderer will submit a list of the main services provided in the last 3 years (calculated by the deadline for submission of tenders), containing values, periods of supply, beneficiaries, whether they are contracting authorities or private customers.

Where the contracting authority / entity is required, for whatever reasons, to delay the deadline set for the submission of applications / tenders, the lower limit of the period of 3 (three) years shall be extended by the time period related to the gap, to be considered to be met the requirement for all operators who have submitted proof of the completion of the similar experience contract within the new result period.

In this respect, the tenderer will demonstrate that it has provided, in the last 3 years, up to 3 contracts, IT services similar to maintenance services or other IT services for a computer system of at least 7,438.016,53 lei without VAT. Where the contracting authority is required, whatever the reason for delaying the deadline for submission of tenders, the lower limit of the period shall be extended by the period corresponding to the delay.

Method of implementation: The DUAE shall be completed by the participating economic operators (bid / bid associate / third party supporter) in the award procedure with the information describing their level of experience, by reference to contracts executed in the past, corresponding to the requirements of the contracting authority / entity.

At DUAE level, information should be specified such as: the number and date of the contract invoked as a similar experience, the description of the services provided, the value, the beneficiary, the period during which the contract was implemented. For contracts which the tenderer will submit to demonstrate similar experience, the following information will be completed:

• the type of contract;
• the subject matter of the contract;
• the description of the services provided
• the value of the services provided.
• the beneficiary of the contract;
• total contract price;
• the period during which the contract was implemented. Note 1: Service supplies shall be confirmed by the presentation of certificates / documents issued or countersigned by an authority or by the beneficiary private client. Note 2: Similar services include the provision of maintenance services of a computer system. Information system means a set of components: database, application and interface with other information systems or end-users.

If the tender is submitted by an economic operator who may have the intention to subcontract part / parts of the contract, the DUAE shall be submitted to the tenderer and the subcontractor (under Article 193 of Law No 98 / 2016) and the subcontracting agreement to that effect. Method of implementation: The tenderer shall also submit with the DUAE the subcontracting agreement specifying the percentage of subcontracting and the activities of the subcontractor.

The tenderer shall demonstrate that it has implemented and maintains a quality management system according to ISO 9001 or equivalent. Companies under certification shall not be allowed, regardless of the stage of the certification process. Method of implementation: DUAE will be supplemented by economic operators participating in the award procedure with information on quality management systems. The supporting documents (valid certificates issued by accredited certification bodies or other evidence) proving the fulfilment of the requirement will only be submitted by the highest bidder in the intermediate ranking drawn up on completion of the evaluation of tenders.
