Jamstvo za ozbiljnost ponude dostavlja se u obliku garancije banke ili uplatom novčanog pologa u korist računa naručitelja.
Trajanje jamstva za ozbiljnost ponude ne smije biti kraće od roka valjanosti ponude.
Garancija banke sadržajno mora biti u obliku Obrasca jamstva za ozbiljnost ponude - posebni dio dokumentacije o nabavi (Naručitelj u sklopu DON dostavlja predložak garancije, ali ne obvezuje Ponuditelje da garancija mora biti u navedenoj formi)
Jamstvo ne smije biti ni na koji način oštećeno (bušenjem, klamanjem i sl.).
Kod elektroničke dostave ponude traženu garanciju banke, ponuditelj u roku za dostavu ponuda, dostavlja Naručitelju u zatvorenoj omotnici na adresu za dostavu sukladno uputama iz točke Način dostave, Dokument Upute za ponuditelje, kojom je propisan način dostava dijelova ponude koji se dostavljaju odvojeno od ponude dostavljene putem EOJN.
Ako je bankarska garancija potpisana/ovjerena naprednim elektroničkim potpisom, istu nije potrebno dostaviti u papirnatom obliku.
Ukoliko banka koja izdaje traženo jamstvo ima sjedište izvan Republike Hrvatske, dužna je imati odgovarajuću banku (corresponding bank) na području Republike Hrvatske preko koje će jamstvo biti dostavljeno SWIFT-om. U ovom slučaju potrebno je od odgovarajuće banke iz Republike Hrvatske dostaviti original obavijest sa SWIFT-om na adresu naručitelja sukladno uputama iz točke Način dostave, Dokument Upute za ponuditelje, kojom je propisan način dostava dijelova ponude koji se dostavljaju odvojeno od ponude dostavljene putem EOJN.
Naručitelj može poslati zahtjev za naplatu SWIFT porukom ili dostavom na adresu banke.
Bilo koji gospodarski subjekt može biti nalogodavac, a jamstvo mora glasiti na ponuditelja ili članove zajednice ponuditelja.
U slučaju zajednice gospodarskih subjekata jamstava za ozbiljnost ponude može dostaviti bilo koji član iz zajednice gospodarskih subjekata u cijelosti ili parcijalno s članom/ima, u obliku i ukupnom iznosu kako je propisano dokumentacijom o nabavi.
