What the buyer wants

1. The subject of the contract is the provision of technical assistance and maintenance services for the STRADOM System. The detailed description of the subject-matter of the contract shall include a model of the Agreement, together with the Annexes, which shall be annexed No 10 to the Specification of the terms of the contract (hereinafter:SWZ). 2.The Contracting Authority in this proceeding does not divide the contract into parts or allow for the submission of partial tenders:The subject matter of the contract, i.e. ‘Service of technical assistance and maintenance service for the STRADOM system’, according to the Contracting Authority, by its nature, scope and manner of implementation constitutes an indivisible, coherent whole, which justifies the withdrawal from the division of the contract into lots. The scope of the contract includes interrelated activities related to the ongoing maintenance of the STRADOM System, technical assistance and ensuring the proper and safe functioning of the STRADOM System. The performance of these tasks requires that uniform technical, organisational and procedural standards be maintained and that one Contractor is clearly responsible for the performance of the contract. The division of the contract into parts could lead to difficulties in coordinating actions, dispersal of responsibility and, consequently, risk of reducing the quality of the services provided or disrupting the continuity of the system. For economic and organisational reasons, the division of the contract into parts could also result in an increase in the costs of performance of the contract, the need for additional coordination by the Contracting Authority and an increase in the response time to notifications and failures, which would be contrary to the principle of efficient and rational management of public funds. The absence of sub-contracting does not affect the principles of fair competition or equal treatment of economic operators and does not restrict access to contracts for micro, small and medium-sized enterprises. 3.The Contracting Authority does not require the performance of the contract by protected work establishments, social cooperatives or other economic operators covered by the provision of Article 94(1) of the Act. 4. The Contracting Authority shall, pursuant to Article 95(1) of the Act, require that persons performing the telephone consultation work referred to in paragraph 4 of Annex 1 to the Model Agreement be employed on the basis of an employment relationship by the Contractor (or subcontractor). The performance of these activities shall consist in carrying out the work as defined in Article 22(1) of the Act of 26 June 1974. – Labour Code (i.e. Journal of Laws of 2025 item 277 as amended). Look out! This requirement does not apply to bids: natural persons engaged in business activities and partnerships who undertake to provide these activities to the company. 5. The Contracting Authority does not provide for the possibility of awarding contracts as referred to in Article 214(1)(7) of the Act. 6.The Contracting Authority shall not allow the submission of variants. 7. The Contracting Authority does not foresee an electronic auction. 7. Prior to the initiation of the procedure, the Ordering Party did not conduct a preliminary market consultation. 8. Contractors in this proceeding shall not require Contractors to submit the evidence in question. 9. The Contracting Authority, within the limits of the provisions of Article 462 et seq. of the Act, allows the Contractor to carry out the subject of the contract using subcontractors. The contractor who intends to entrust the performance of part of the contract to subcontractors shall indicate in the tender the parts of the contract which he intends to entrust to subcontractors (including suppliers) and the names of any subcontractors (including suppliers) if they are already known. 10.The Contracting Authority shall make available to Contractors the following do…

1. Przedmiotem zamówienia jest świadczenie usługi asysty technicznej i konserwacji dla Systemu STRADOM. Szczegółowy opis przedmiotu zamówienia zawiera wzór Umowy wraz z załącznikami, stanowiący załącznik nr 10 do Specyfikacji warunków zamówienia (dalej:SWZ). 2.Zamawiający w niniejszym postępowaniu nie dzieli zamówienia na części ani nie dopuszcza możliwości składania ofert częściowych:Przedmiot zamówienia pn. „Świadczenie usługi asysty technicznej i konserwacji dla Systemu STRADOM”, zdaniem Zamawiającego ze względu na swój charakter, zakres oraz sposób realizacji stanowi niepodzielną, spójną całość, co uzasadnia odstąpienie od podziału zamówienia na części.Zakres zamówienia obejmuje wzajemnie powiązane czynności związane z bieżącym utrzymaniem Systemu STRADOM, asystą techniczną oraz zapewnieniem prawidłowego i bezpiecznego funkcjonowania Systemu STRADOM. Realizacja tych zadań wymaga zachowania jednolitych standardów technicznych, organizacyjnych i proceduralnych oraz zapewnienia jednoznacznej odpowiedzialności jednego Wykonawcy za efekt realizacji zamówienia. Podział zamówienia na części mógłby prowadzić do trudności w koordynacji działań, rozproszenia odpowiedzialności, a w konsekwencji do ryzyka obniżenia jakości świadczonych usług lub zakłócenia ciągłości działania systemu.Ze względów ekonomicznych i organizacyjnych podział zamówienia na części mógłby również skutkować zwiększeniem kosztów realizacji zamówienia, koniecznością dodatkowej koordynacji po stronie Zamawiającego oraz wydłużeniem czasu reakcji na zgłoszenia i awarie, co byłoby sprzeczne z zasadą efektywnego i racjonalnego gospodarowania środkami publicznymi.Brak podziału zamówienia na części nie narusza zasad uczciwej konkurencji ani równego traktowania wykonawców i nie ogranicza dostępu do zamówienia dla mikro, małych i średnich przedsiębiorstw. 3.Zamawiający nie wymaga realizacji zamówienia przez zakłady pracy chronionej, spółdzielnie socjalne, czy innych wykonawców objętych dyspozycją przepisu art. 94 ust. 1 ustawy. 4. Zamawiający, na podstawie art. 95 ust. 1 ustawy, wymaga zatrudniania na podstawie stosunku pracy przez Wykonawcę (lub podwykonawcę) osób wykonujących prace w zakresie konsultacji telefonicznych, o których mowa w ust. 4 Załącznika nr 1 do wzoru Umowy. Wykonywanie tych czynności polega na wykonywaniu pracy w sposób określony w art. 22 § 1 ustawy z dnia 26 czerwca 1974 r. – Kodeks pracy (t. j. Dz. U. z 2025 r. poz. 277 ze zm.). Uwaga! Wymóg ten nie dotyczy składających oferty: osób fizycznych prowadzących działalność gospodarczą oraz wspólników spółek osobowych, którzy zobowiążą się do osobistego świadczenia tych czynności na rzecz spółki. 5. Zamawiający nie przewiduje możliwości udzielania zamówień, o których mowa w art. 214 ust. 1 pkt 7 ustawy. 6.Zamawiający nie dopuszcza składania ofert wariantowych. 7. Zamawiający nie przewiduje przeprowadzenia aukcji elektronicznej. 7. Zamawiający przed wszczęciem postępowania nie przeprowadził wstępnych konsultacji rynkowych. 8. Zamawiający w niniejszym postępowaniu nie wymaga od Wykonawców przedłożenia przedmiotowych środków dowodowych. 9. Zamawiający, w granicach określonych przepisem art. 462 i nast. ustawy, dopuszcza możliwość realizacji przedmiotu zamówienia przez Wykonawcę z wykorzystaniem podwykonawców. Wykonawca, który zamierza powierzyć wykonanie części zamówienia podwykonawcom, wskazuje w ofercie części zamówienia, których wykonanie zamierza powierzyć podwykonawcom, (w tym dostawcom) oraz podaje nazwy ewentualnych podwykonawców (w tym dostawców), jeżeli są już znani. 10.Zamawiający udostępnia Wykonawcom następującą dokumentację, która powstała w ramach realizacji przedmiotu umowy wdrożeniowej (dokumenty opisane w umowie wdrożeniowej nr W/II/61/OR/1/2013 z dnia 21.05.2013 r., oraz w umowach uzupełniających: nr W/II/1097/OR/4/2014 z dnia 29.07.2014 r., nr W/II/17/OR/3/2015 z dnia 16.02.2015 r., nr W/II/3195/IT/28/2019 z dnia 29.10.2019 r. i W/I/2638/IT/68/2022 z dnia 11.10.2022 r.).

Contractors who, in accordance with Article 57(2) of the Act, fulfil the condition of participation in the proceedings, i.e. in terms of technical or professional capacity: they have knowledge and experience, i.e. during the last 5 years before the deadline for the submission of tenders in the procedure (and if the period of business is shorter, during that period) have duly performed (started and completed) or carried out (started and currently implemented at the time of the tender) at least one service (service of technical assistance and support for the IT system) continuously for at least 11 months, with a value of at least PLN 500 000,00 gross, during that period. Look out! In the case of a service continued by the Contractor, a service already provided for at least 11 full calendar months until the submission of the offer must be demonstrated and proof of proper performance of the service must confirm that the service has been carried out so far for at least 11 full calendar months.
