1. The subject of the contract is ,,,Purchase of DMR radiotelephones for units of TSOs of Podkarpackie province” under the Civil Protection and Civil Defence Programme for the years 2025-2026 A detailed description of the subject of the order is given in Annex 4 to the WWZ. 2. If the documentation would indicate, in respect of certain materials and equipment, trademarks, patents or origins of the Contracting Authority, in accordance with Article 99(5) of the Act, permits the submission of equivalent products. All products from specific manufacturers shall specify the minimum quality parameters and performance characteristics to be met by the goods in order to meet the requirements laid down by the Contracting Authority and shall constitute only a quality standard of the object of the contract. By recording the minimum requirements of the quality parameters, The purchaser understands the requirements of goods contained in generally available sources, catalogues, producer websites. The operation of the manufacturer's sample names is only intended to clarify the level of expectations of the Ordering Party in relation to a specific solution. Thus, the use of producer names / products / is only exemplary. The Contracting Authority, when describing the subject-matter of the contract, indicating the designation of the particular manufacturer (supplier) or the specific product, shall at the same time allow equivalent products with quality parameters and performance characteristics, at least at the level of the parameters of the specified product, thereby recognising each product with the specified parameters or better. In such a situation, the Contracting Authority shall require the submission of relevant documents (including the offer), which shall make these materials or equipment credible. They will be assessed by the Contracting Authority, which will be the basis for the Contracting Authority's decision to accept "equivalents". The Contracting Authority reserves the right to comment on the materials or devices offered. Where the Contractor fails to submit documents on the use of other materials and devices, it shall be understood that the materials and devices proposed in the description of the subject of the order are included in the calculation of the price of the offer. 3. Describing the subject matter of the contract in the attached detailed description of the subject matter of the contract by reference to standards, technical assessments, technical specifications and technical reference systems as referred to in Article 101(1)(2) and (3) of the Public Procurement Law, The Contracting Authority shall allow equivalent solutions to be described and the words " or equivalent shall accompany each such description.’ 4. The technical and qualitative characteristics of the subject-matter of the contract should comply with the Polish standards that carry European standards or standards of other Member States of the European Economic Area.
