What the buyer wants

1) The subject of the contract is the purchase of HDPS (CommVault) technical support. 2) The detailed description of the subject-matter of the contract can be found in Part II of the EGM and Part IV of the EGM. 3) Pursuant to Article 101(4) of the Act The Contracting Authority shall allow solutions equivalent to those described in the WWZ by means of standards, technical assessments, technical specifications and technical reference systems as referred to in Article 101(1)(2) and (3) of the Act if they allow to obtain characteristics or parameters no worse than those mentioned. Pursuant to Article 101(5) of the Act, the Contractor, who cites equivalent solutions described by the Contracting Authority, is obliged to prove in the offer that the proposed solutions meet the requirements laid down in the description of the contract to an equivalent extent. 4) The Contracting Authority requires the Contractor to indicate, in the offer, the parts of the contract which the Contractor intends to entrust to the Contractors and to provide by the Contractor the Subcontractors if they are already known. 5. Name and code of the Common Procurement Dictionary: 72000000-5. 6) The Contracting Authority shall not require the submission of the evidence in question. 7. Pursuant to the provisions of 438 of the Act in conjunction with Article 95(1) of the Act, the requirements for the obligation to employ employees are laid down in Part II of the SWZ and Part IV of the SWZ (the requirement concerns the Contractor Coordinator). 8. Requirements for ICT products, ICT services and ICT processes: The Contracting Authority shall require that the subject of the contract, including any ICT products, ICT services and ICT processes, within the meaning of points 11k, 11l and 11m of Article 2 of the Act of 5 July 2018 on the National Cybersecurity System, used for the execution of the contract, both as principal elements and components, elements of the procurement environment or accompanying solutions, do not include: 1) ICT products, ICT services or ICT processes indicated in the recommendation of the Government Plenipotentiary for Cybersecurity referred to in Article 33(4) and 4a of the Act of 5 July 2018. on a national cybersecurity system that has a negative impact on the essential interest of State security; 2) ICT products, ICT services or ICT processes, the type of which has been identified in the decision of the Minister for Information Technology on the recognition of a supplier as a high-risk provider referred to in Article 67b(15) of the Act of 5 July 2018 on the National Cybersecurity System. Failure to comply with this requirement will result in the rejection of the tender, in the case of public contracts pursuant to point 17 or point 19 of Article 226(1) of the Act of 11 September 2019. Public procurement law. The Contracting Authority reserves the right to verify compliance with this requirement at each stage of the procedure.

1) Przedmiotem zamówienia jest zakup wsparcia technicznego HDPS (CommVault). 2) Szczegółowe określenie przedmiotu zamówienia znajduje się w Części II SWZ oraz Części IV SWZ. 3) Zgodnie z art. 101 ust. 4 ustawy Zamawiający dopuszcza rozwiązania równoważne opisywanym w SWZ za pomocą norm, ocen technicznych, specyfikacji technicznych i systemów referencji technicznych, o których mowa w art. 101 ust. 1 pkt 2 oraz ust. 3 ustawy, jeżeli pozwolą one uzyskać cechy lub parametry nie gorsze niż przywołane. Zgodnie z art. 101 ust. 5 ustawy, Wykonawca, który powołuje się na rozwiązania równoważne opisywanym przez Zamawiającego, jest obowiązany udowodnić w ofercie, że proponowane rozwiązania w równoważnym stopniu spełniają wymagania określone w opisie przedmiotu zamówienia. 4) Zamawiający żąda wskazania przez Wykonawcę, w ofercie, części zamówienia, których wykonanie zamierza powierzyć Podwykonawcom i podania przez Wykonawcę firm Podwykonawców, jeżeli są już znani. 5) Zamawiający nie wymaga złożenia wraz z ofertą przedmiotowych środków dowodowych. 6) Stosownie do postanowień 438 ustawy w związku z art. 95 ust. 1 ustawy wymagania w zakresie obowiązku zatrudnienia pracowników określono w Części II SWZ i Części IV SWZ (wymóg dotyczy Koordynatora Wykonawcy). 7) Wymagania dotyczące produktów ICT, usług ICT oraz procesów ICT: Zamawiający wymaga, aby przedmiot zamówienia, w tym wszelkie produkty ICT, usługi ICT oraz procesy ICT, w rozumieniu art. 2 pkt 11k, 11l oraz 11m ustawy z dnia 5 lipca 2018 r. o krajowym systemie cyberbezpieczeństwa, wykorzystywane do realizacji zamówienia – zarówno jako elementy główne, jak i komponenty, elementy środowiska realizacji zamówienia lub rozwiązania towarzyszące – nie obejmowały: 1) produktów ICT, usług ICT ani procesów ICT wskazanych w rekomendacji Pełnomocnika Rządu do spraw Cyberbezpieczeństwa, o której mowa w art. 33 ust. 4 i 4a ustawy z dnia 5 lipca 2018 r. o krajowym systemie cyberbezpieczeństwa, stwierdzającej ich negatywny wpływ na podstawowy interes bezpieczeństwa państwa; 2) produktów ICT, usług ICT ani procesów ICT, których typ został określony w decyzji ministra właściwego do spraw informatyzacji w sprawie uznania dostawcy za dostawcę wysokiego ryzyka, o której mowa w art. 67b ust. 15 ustawy z dnia 5 lipca 2018 r. o krajowym systemie cyberbezpieczeństwa. Niespełnienie powyższego wymagania będzie skutkowało odrzuceniem oferty, w przypadku zamówień publicznych stosownie do art. 226 ust. 1 pkt 17 lub pkt 19 ustawy z dnia 11 września 2019 r. – Prawo zamówień publicznych. Zamawiający zastrzega sobie prawo weryfikacji spełnienia powyższego wymagania na każdym etapie postępowania.
