School chair szt. 30 The Contracting Authority shall require that the supply offered, including all ICT products, ICT services and ICT processes used for the performance of the contract, both as principal elements and components, elements of the service environment or accompanying solutions, does not include: (a) ICT products, ICT services or ICT processes identified in the recommendation referred to in Article 33(4) of the Law of 5 July 2018 on the national cybersecurity system, stating that they have a negative impact on the fundamental interest of the State security; (b) an ICT product of which the type is defined in the decision to recognise the supplier as a high risk provider referred to in Article 67b(15) of the Law of 5 July 2018 on the national cybersecurity system, or the ICT services or ICT processes specified in that decision. Failure to comply with this requirement results in the rejection of the tender pursuant to point 17 of Article 226(1) or point 19 of the Pzp Act respectively, the subject-matter of the contract is described in Part II (OPP), in which the contracting authority determines the minimum technical parameters for equipment and the number of pieces of the individual product range for all the above-mentioned parts. The Contracting Authority allows equivalent equipment – equivalence means the possibility for the Contractor to offer products with other trademarks, patents or origins, while with the same characteristics (or better, higher standard) required by the Contracting Authority. 2. The Contracting Authority does not reserve the obligation of the Contracting Authority to perform the key tasks personally.

Fotel dla pacjenta do terapii EEG Biofeedback szt. 1 Zamawiający wymaga, aby oferowane świadczenie, w tym wszystkie produkty ICT, usługi ICT oraz procesy ICT wykorzystywane do realizacji zamówienia, zarówno jako elementy główne, jak i komponenty, elementy środowiska świadczenia usługi lub rozwiązania towarzyszące, nie obejmowało: a) produktów ICT, usług ICT lub procesów ICT wskazanych w rekomendacji, o której mowa w art. 33 ust. 4 ustawy z dnia 5 lipca 2018 r. o krajowym systemie cyberbezpieczeństwa, stwierdzającej ich negatywny wpływ na podstawowy interes bezpieczeństwa państwa; b) produktu ICT, którego typ został określony w decyzji w sprawie uznania dostawcy za dostawcę wysokiego ryzyka, o której mowa w art. 67b ust. 15 ustawy z dnia 5 lipca 2018 r. o krajowym systemie cyberbezpieczeństwa, ani usług ICT lub procesów ICT określonych w tej decyzji. Niespełnienie powyższego wymagania skutkuje odrzuceniem oferty odpowiednio na podstawie art. 226 ust. 1 pkt 17 albo pkt 19 ustawy Pzp Szczegółowo przedmiot zamówienia opisany został w SWZ CZĘŚĆ II (OPZ), w którym zamawiający określa minimalne parametry techniczne dotyczące sprzętów oraz ilości sztuk poszczególnego asortymentu dla wszystkich ww. części. Zamawiający dopuszcza sprzęt równoważny – równoważność oznacza możliwość zaoferowania przez wykonawcę produktów o innych znakach towarowych, patentach lub pochodzeniu, natomiast o takich samych właściwościach (lub lepszych, wyższych standardem) wymaganych przez zamawiającego. 2. Zamawiający nie zastrzega obowiązku osobistego wykonania przez wykonawcę kluczowych zadań.
