Tenderers (including supporting associations / third parties) are required to complete and present a separate DUAE initially. The supporting documents proving the fulfilment of those assumed by the completion of the DUAE shall be submitted, at the request of the contracting authority, only by the highest bidder following the application of the award criterion (including the supporting associations / third parties). These documents are:
- For Romanian legal entities: will be required the certificate issued by the Ministry of Justice - the Office of the Trade Registry resulting in the full name, registered office and point / working points, authorized persons (administrators / authorized persons), main activity domain / secondary activity domains and related CAEN codes
- For foreign legal entities: edifying documents will be required to prove a form of registration / attestation or professional membership, in accordance with the legislation of the country of residence of the economic operator.
- For Romanian / foreign individuals: edifying documents will be required to prove a form of registration as authorized natural person, in accordance with the legislation of the country of residence of the economic operator.
The average annual turnover of the tenderer over the last three years (2023, 2024, 2025) must be at least equal to or greater than the sum of MDL 2.100.840.34, representing the estimated value of the contract expected to be awarded, in order not to restrict the participation of economic operators due to the high level of turnover. the DUAE will be completed by the economic operators participating in the award procedure with information related to their situation.
The supporting documents proving the fulfilment of those assumed by the completion of the DUAE shall be: appropriate bank statements or extracts, presentation of financial statements or extracts from financial statements, where the publication of financial statements is provided for by the legislation of the country in which the economic operator is established or a declaration of the total turnover of the economic operator for the last three financial years available at the latest, depending on the date of establishment or commencement of the economic operator's activity, in so far as information on the turnover is available.
Note: The supporting documents proving the fulfilment of those assumed by the completion of the DUAE are to be submitted, at the request of the contracting authority, by the economic operator ranked first, under the conditions laid down in Article 196 of Law No 98 / 2006 on public procurement, with subsequent amendments and additions.
If the economic operator demonstrates its economic and financial situation by invoking the support of a third party, then the economic operator shall be required to prove to the contracting authority that it has taken all necessary measures to have access at any time to the necessary resources, making an undertaking to that effect by the third party.
With the support commitment, the tenderer is obliged to submit documents submitted to him by the supporting third party (s), which will result in the actual way in which the supporting third party (s) will / will ensure the fulfilment of their own support commitment, which will be attached to that commitment.
The third party (s) providing support for the fulfilment of the economic and financial situation criteria meets / meets the relevant capacity criteria or does not fall within the grounds for exclusion provided for in Articles 164, 165 and 167 of Law No 98 / 2016, as amended and supplemented.
List of main service supplies similar to those covered by the contract, received by the beneficiaries, in part or in total, over the last 3 years, calculated by reference to the closing date for the submission of tenders (indicating the values, data and public or private beneficiaries), resulting in the provision of similar services in the aggregate value of at least the estimated value of the contract that is expected to be awarded respectively: 2.100.840.34 lei; DUAE shall be completed by the economic operators participating in the award procedure with information relating to their situation.
The supporting documents proving the fulfilment of those undertaken by the completion of the DUAE are to be submitted, at the request of the contracting authority, under the conditions laid down in Article 196 of Law No 98 / 2016 on public procurement, with subsequent amendments and additions.
In accordance with the degree of complexity of the contract to be concluded, it is considered necessary that the successful tenderer with whom the contract is to be concluded is one with an appropriate experience for the performance of such a contract, that it be able to provide quality services.
The provision of services shall be confirmed by the submission of record certificates / certificates of good performance / minutes of receipt / recommendations / copies of relevant parts of contracts performed / documents issued or countersigned by an authority or by the beneficiary private client. If the tender is technically and professionally supported, a firm commitment from the third party shall be submitted on the date of submission of tenders. Information on subcontracting (if applicable). The tenderers will declare the subcontractors at the time of submission of the offer and will complete a separate DUAE in this respect (the requirement also valid for the supporting third party, if any). to be completed DUAE.
The supporting documents proving the fulfilment of those undertaken by the completion of the DUAE are to be submitted, at the request of the contracting authority, only by the highest bidder drawn up on completion of the evaluation of tenders, after the award criterion has been applied. If the offer is submitted by an association each associate must complete a separate DUAE and with the submission of the DUAE will also be submitted the Subcontracting Agreement.
The supporting documents proving those entered into the Agreement will be requested only to the successful tenderer at the request of the contracting authority. The offer submitted by an association of economic operators must meet the following requirements:
- the offer must be legally signed by all associations;
- the tender must include an Association Agreement;
- the structure of the association will not be changed, during the execution of the framework agreement, except with prior approval of the acquirer. If a bid submitted by a group (association) of more than one economic group is declared successful, they will legalise their association before the Framework Agreement is signed.In the case of an association, each associate shall submit documents showing that the requirements concerning the personal situation of economic operators, those relating to entry in the register of trade or profession and the requirements for economic and professional capacity are met.The non-submission with the tender, DUAE, of the firm commitment of the supporting third party to the effective way in which its support, or where appropriate, of the subcontracting agreement and / or the association agreement, will result in its rejection as unacceptable. How to demonstrate compliance with the requirement: complete the DUAE by each associate and submit the Association Agreement with the submission of the DUAE.The supporting documents proving the fulfilment of those undertaken by the completion of the DUAE are to be submitted, at the request of the contracting authority, only by the highest bidder drawn up on completion of the evaluation of tenders, after the award criterion has been applied.

- Viziunea strategică pentru modernizarea și sustenabilitatea sistemului informatic (5 ani)6%
Nivel 1 - Acceptabil (2 puncte): Ofertantul prezintă o viziune generală, dar superficială, care se rezumă la reluarea cerințelor din Caietul de Sarcini, fără a propune elemente inovatoare sau o direcție clară de evoluție pe 5 ani. Nu sunt identificate tendințe tehnologice relevante sau modalități de adaptare a platformei la acestea. • Nivel 2 - Bine (4 puncte): Ofertantul descrie o viziune clară pentru următorii 5 ani, identificând direcții principale de dezvoltare.
