Economic operators submitting the offer must prove a form of registration under the conditions of the law of the country of residence, to reiterate that the economic operator is legally constituted, that it is not in any of the situations of annulment of the constitution and that it has the professional capacity to perform the activities covered by the framework agreement.

How to demonstrate compliance with the requirement: the D.U.A.E. will be completed by economic operators participating in the award procedure with information related to their situation. The supporting documents proving the fulfilment of those assumed by the completion of the D.U.A.E. shall be submitted, at the request of the contracting authority, only by the highest bidder in the intermediate ranking drawn up on completion of the evaluation of tenders. Documents requested:

1. for Romanian legal entities: - certificate issued by the Trade Register Office;
2. for foreign legal entities: - edifying documents proving a form of registration as legal person or of registration / attestation or professional membership, in accordance with the legal provisions of the country in which the tenderer is resident. The documents will be accompanied by the authorized translation into Romanian, according to the legislation in force in the case of an association, each associate must present these documents.As the documents will be requested from the highest bidder, they will be valid at the time of submission. Failure to submit such documents shall lead to the exclusion of the tenderer from the proceedings.

For goods purchase contracts: certificates issued by quality control bodies. The bidders submitting the offer were to hold the NATO Code of Economic Agent (Certificate of Allocation of the NATO Economic Agent Code (NCAGE - awarded by the National Coding Office or SCAGE Code - assigned by NAMSA - NATO Agency of Maintenance and Supply according to the state in which the tenderer is registered).

It will be completed in this respect in DUAE by the tenderers participating in the award procedure and the supporting documents will be submitted only at the request of the contracting authority upon completion of the evaluation of the tenders.

The highest bidder in the intermediate ranking presents the possession of the NATO Economic Agent Code (NCAGE - awarded by the National Coding Office or the NCAGE Code - awarded by NAMSA - NATO Maintenance and Supply Agency, and if it does not hold this code, it will present the NCAGE Form, subject to the presentation of the NATO Economic Agent Code at the time of signing the supply contract. Under Article 10 of H.G. No. 445 / 2003, in order to be able to conclude a purchase contract with MAPN, the supplier must obtain NATO code as an economic agent.
