Economic operators submitting the offer must prove a form of registration under the conditions of the law of the country of residence, from which to reiterate that the economic operator is legally constituted, that it is not in any of the situations of annulment of the constitution and that it has the professional ability to perform the activities covered by the contract. Method of delivery: complete DUAE in accordance with Art. 193 para. 1 of Law 98 / 2016.

As regards how to complete the DUAE, economic operators will be able to limit themselves to indicating overall that they meet the qualification / selection requirements. The ONRC certificate / equivalent documents issued in the country of residence must be submitted only at the request of the contracting authority, the highest bidder in the ranking; the information in the documents must be valid at the date of presentation. Notes:

1. The documents submitted must mention: identification data, shareholders / associations, management bodies, administrators, participation rates. The information contained in the certificate must be real / current at the time of its presentation.
2. In the case of an association, each associate shall be obliged to submit these documents for the part of the contract it fulfils.

The tenderer shall demonstrate a similar experience by providing products similar to those described in the specification, i.e. the supply of hardware / IT equipment from the category of computers (desktops, workstations, allin- one systems or similar), with / without the license the operating system included, completed, over the last 3 years. The minimum requirement will be fulfilled from maximum 3 contracts in cumulative value of 1.800,000 lei without VAT.

The last 3 years shall be calculated by reference to the deadline for submission of tenders established by the contracting authority by the contract notice. Thus, according to the provisions of art. 13 paragraph (2) of the Instruction of the President of ANAP no. 2 / 2017, if the deadline for submission of tenders is extended accordingly (with the days of delay) and the period related to similar experience.

For the calculation of equivalence, the average annual leu / other currency reported by the NBR for each year shall be applied. If a group of economic operators submits a joint offer, the requirement shall be demonstrated by taking into account the resources of all members of the group. In this situation, the associate tenderer will also complete the DUAE as well as the required documents on how to meet the requirement. The Association Agreement will also be submitted with the DUAE.

Information regarding the supporting third party in technical or professional support granted to the tenderer: If the tenderer receives support from a third party (s) in order to meet a qualification criterion (s), the tenderer is required to complete the DUAE and to present with DUAE the firm commitment to technical and professional support granted by the supporting third party, resulting in the actual way in which its support will materialise.

According to the provisions of art. 184 of Law no. 98 / 2016 with subsequent completions, by firm commitment, the third party / third parties will undertake to jointly respond with the tenderer for the performance of the public procurement contract. The joint responsibility of the supporting third parties / third parties will be committed under the condition that he / she fails to fulfil the support obligations assumed by the commitment. Together with DUAE, the support commitment and its annexes will be submitted.

Method of delivery: Filling DUAE under Art. 193 para. 1 of Law 98 / 2016. Regarding how to complete the DUAE. DUAE shall be completed by economic operators participating in the award procedure with information describing their level of experience, by reference to contracts executed in the past, in accordance with the requirements of the contracting authority / entity. The nominated association / associations will present to you the distinct DUAE in which the requested information will be included.

The following supporting documents proving the fulfilment of the requirement shall be submitted only by the highest bidder / bidders in the ranking drawn up on completion of the evaluation of tenders: the minutes of receipt or other documents showing the following information: beneficiary, quantity / value (expressed in lei without VAT), period and place of delivery, recommendations; other equivalent documents.

Information on subcontracting: The tenderer shall specify the part (s) of the contract to be subcontracted and the recognition dates of the proposed subcontractors. On the basis of Article 55 (1) of Law No 98 / 2016, the contracting authority shall require the tenderer to specify in the tender:

1. the categories of services / activities in the contract it intends to subcontract, and the percentage or value of the activities indicated in the tender as being carried out by subcontractors; and
2. the identification data of the proposed subcontractors. The subcontractor must not be in the situations provided for in Articles 59 to 60 of Law No 98 / 2016, subject to the exclusion from the award procedure. The proposed subcontractor / subcontractors shall not fall within the exclusion grounds provided for in Articles 164, 165 and 167 of the Law no.98 / 2016.Method of delivery: information required for subcontractors will also be included in the DUAE completed by the tenderer. If a qualification requirement is not met by subcontracting, it shall submit the DUAE only for the purpose of demonstrating non-compliance with the exclusion grounds.All tenderers shall be required to submit the Subcontracting Agreement (s) with the submission of the DUAE and to submit the supporting documents of the subcontractor (s) at the request of the contracting authority, only by the highest bidder in the intermediate ranking drawn up on completion of the evaluation of tenders.Where the tenderer uses the capacities of the subcontractor / subcontractors to meet the qualification criteria, a separate DUAE form shall be submitted for each of those subcontractors, duly completed and signed by them. Subcontractors shall specify in the DUAE the information related to the qualification criteria they meet by mentioning the number and date of subcontracting contract / agreement for the proposed subcontracting party.The procuring entity may reject the proposed subcontractor if it does not meet the qualification requirements for capacity or falls within the grounds for exclusion and requests the candidate / tenderer to replace it and to submit another subcontractor.
