The subject of the contract is the provision by the Contractor of technical, organisational and formal consultancy services for the preparation and conduct of procurement procedures for the supply and implementation of the Enterprise Resource Planning (hereinafter referred to as the ERP system) and for the implementation of this system in the Contracting Infrastructure, under the conditions laid down in the essential provisions of the Agreement, hereinafter referred to as the IPU, as Annex No 8 to the SWI and its Annexes (hereinafter referred to as the Advisory Services).

1. The condition for participation in the procedure regarding professional ability in terms of the Contractor's experience will be met if the Contractor demonstrates that within the last 7 years, counting backwards from the deadline for submission of tenders, and if the period of business activity is shorter – within this period, it has performed or is performing at least: 1) three services involving the performance of an IT system analysis, including infrastructure analysis for IT projects. 2) three services supporting the preparation and conduct of a public procurement procedure conducted in accordance with the Public Procurement Act, the subject of which was the supply of an ERP-class IT system containing at least the following modules: Financial planning/budgeting, finance and accounting, HR and payroll, fixed assets, where each service included the preparation of procurement documentation (defining at least the conditions for participation in the procedure, tender evaluation criteria, material contractual provisions, contract template or draft contract). 3) three advisory services for the implementation of an ERP-class system, provided independently of entities interested in selling or implementing the software. This means that the Contractor, within the performance of these services, could not have had capital, personal, or contractual ties (e.g., as a commercial partner, reseller, or integrator) with the manufacturer or supplier of the implemented ERP system, provided that: a) in at least two services, an ERP-class system of a different manufacturer was implemented; b) in at least one case, the implementation of the ERP-class system included its integration with at least one domain-specific system. By domain-specific system, the Contracting Authority understands an IT system supporting the execution of specialized substantive processes specific to the operations of a given organization or industry, which is not an ERP-class system, with which the ERP system exchanges data via integration interfaces. c) in at least one case, the minimum number of users of the implemented ERP-class system was 1,000, d) at least one of the services was performed for a public finance sector entity. Note: In the case of an ongoing service whose performance did not end before the deadline for submission of tenders, the Contractor may demonstrate only the scope of the service performed up to the deadline for submission of tenders, for which it can present evidence confirming its proper performance. 2. In the case of Contractors jointly applying for the contract: 1) the condition for participation in the procedure regarding professional ability in terms of the Contractor's experience specified in sec. 1 item 1 must be met in its entirety by one of the Contractors jointly applying for the contract or in its entirety by the entity making resources in the form of experience available to the Contractors jointly applying for the contract. The Contracting Authority does not permit the so-called aggregation of experience; 2) the condition for participation in the procedure regarding professional ability in terms of the Contractor's experience specified in sec. 1 item 2 must be met in its entirety by one of the Contractors jointly applying for the contract or in its entirety by the entity making resources in the form of experience available to the Contractors jointly applying for the contract. 1. The condition for participation in the procurement procedure regarding professional capacity in terms of available personnel will be met if the Economic Operator demonstrates that it has at its disposal or will have at its disposal the following persons who will be assigned to perform the contract: 1) Project Management Expert — at least one person who: a) holds a higher education degree, b) has at least 5 years of experience in IT project management, c) holds project management qualifications confirmed by a PRINCE2 Foundation certificate or higher, or an equivalent certificate. As an equivalent certificate to PRINCE2 Foundation, the Contracting Authority will recognize any other widely recognized, international project management certificate that confirms knowledge of: the full project life cycle, principles of scope, time, budget, and project risk management, as well as roles and responsibilities within a project team – obtained upon passing an examination before an independent certifying body, d) within the last 5 years, counting backwards from the tender submission deadline, acted as a project manager in at least two advisory services involving support in the implementation of an ERP-class system. 2) System Architect — at least one person who: a) holds a higher education degree, b) has at least 5 years of experience in IT systems design, c) holds knowledge in the field of IT organization enterprise architecture documented by a TOGAF 8 Certified Foundation certificate or higher, or an equivalent certificate. As an equivalent certificate to TOGAF 8 Certified, the Contracting Authority will recognize any other widely recognized, international certificate in Enterprise Architecture that confirms knowledge of: IT system architecture design methodologies and frameworks (in the business, data, application, and technology domains), architecture governance principles, and system integration reference models – obtained upon passing an examination before an independent certifying body, d) within the last 5 years, counting backwards from the tender submission deadline, acted as an architect in at least two advisory services involving support in the implementation of an ERP-class system. 3) Analyst — at least 1 person who: a) holds a higher education degree, b) has at least 5 years of experience acting as an analyst in IT system projects, c) within the last 5 years, counting backwards from the tender submission deadline, acted as an analyst in at least two advisory services involving support in the implementation of an ERP-class system. 4) Public Procurement Specialist — at least 1 person who: a) holds a higher education degree, b) has at least 5 years of experience in applying the Public Procurement Law (PPL) Act, c) has experience in preparing at least one Contracting Authority's position (e.g., response to an appeal or accession) regarding an appeal filed with the National Appeal Chamber, d) within the last 5 years, counting backwards from the tender submission deadline, participated in the preparation of tender documentation (ToR/SWZ, conditions for participation in the procedure, tender evaluation criteria, draft contract) and in conducting at least 3 public procurement procedures, pursuant to the PPL Act, concerning the delivery and implementation of IT systems, 5) Legal Counsel, Attorney-at-Law, or Foreign Lawyer within the meaning of the Act of 5 July 2002 on the provision of legal assistance by foreign lawyers in the Republic of Poland – at least 1 person who: a) holds the qualifications/license to practice as a legal counsel, attorney-at-law, or foreign lawyer within the meaning of the Act of 5 July 2002 on the provision of legal assistance by foreign lawyers in the Republic of Poland, b) within the last 5 years, counting backwards from the tender submission deadline, provided legal assistance in at least three projects concerning the delivery and implementation of IT systems conducted on the basis of the provisions of th…

3. At least two persons in the team should have knowledge of good IT management practices, confirmed by a COBIT certificate at Foundation level or higher or equivalent level*, and at least one person should have knowledge of IT service management, confirmed by an ITIL Expert in IT Service Management certificate or higher or equivalent**. *As an equivalent certificate for COBIT, the Contracting Authority will recognise any other internationally recognised IT Governance Certificate, which confirms knowledge of: principles of integration of business objectives with IT objectives, technological risk management and mapping of management processes in the organisation – obtained on the basis of a passed examination before an independent certification body (e.g. CGEIT certificate). **As an equivalent certificate for ITIL, the Contracting Authority will recognise any other widely recognised international IT Service Management certificate that confirms knowledge of: the full lifecycle of IT services, the principles of continuous improvement of services and the design and implementation of technical support processes – obtained on the basis of a passed examination before an independent certification unit. 4. In the case of Contractors jointly applying for a contract, the condition of participation in the procedure concerning the ability to hold persons referred to in paragraphs 1 to 5 of paragraph 1 above Contractors jointly applying for a contract must meet, either together with the entity or entities making available Contractors jointly applying for the procurement of resources in the form of persons to be directed to the performance of the contract. 5. In order to confirm the fulfilment of the condition of participation in the procedure concerning the professional capacity to dispose of persons who will be directed to the performance of the contract, The Contracting Authority, pursuant to Article 126(2) of the Act, requires that the list of persons addressed by the Contractor for the performance of a public contract responsible for the provision of services, together with information on their qualifications, experience and education necessary for the performance of the public contract, as well as on the scope of their activities and on the basis of their disposal (the model of the list of persons is annexed to the SWZ).
