Technical Assistance and Maintenance Service (ATiK) ITS system with development services

1. The subject matter of the contract is in particular: (a) the provision of technical assistance and maintenance services for the IPPS system for the duration of the contract, as part of the basic contract; (b) the provision of development services of a maximum of 1 200 Working Hours, for the duration of the contract, under the option law. The detailed description of the subject-matter of the contract shall include a model of the contract together with the annexes, which shall be annexed to the WWZ. 2. Contractors in this procedure shall not divide the contract into lots or allow for the submission of partial tenders: The subject-matter of the contract, i.e. the provision of technical assistant and maintenance services to the IACSE system and development services, cannot be divided into parts for technical, purposeful and economic reasons, as it constitutes a coherent whole. The split of the contract into parts could lead to coordination difficulties, increased risk of improper provision of services and risks to the continuity of the system. The integrated nature of the system means that the provision of support services should be carried out by one entity fully responsible for the operation of the system. The lack of division into parts does not in any way restrict access to the contract for small and medium-sized enterprises, and Contractors active in the sector covered by the contract can supply all its elements. 3.The Contracting Authority does not require the performance of the contract by protected work establishments, social cooperatives or other economic operators covered by the provision of Article 94(1) of the Act. 4. The Contracting Authority shall, pursuant to Article 95(1) of the Act, require the Contractor (or subcontractor) to employ persons providing a remote assistance service of the type CALL CENTER referred to in point 5 of the Annex to the Agreement. The performance of these activities involves the provision of work as defined in Article 22(1) of the Act of 26 June 1974. – Labour Code (i.e. OJ of 2025, item 277 as amended). (This requirement does not apply to bids: natural persons conducting business activities and partnerships who undertake to provide these activities to the company in person.) 5. The Contracting Authority does not provide for the possibility of awarding contracts as referred to in Article 214(1)(7) of the Act. 6. The Contracting Authority does not allow variants. 7. The Contracting Authority does not foresee an electronic auction. 8. Prior to the initiation of the procedure, the Ordering Party did not conduct preliminary market consultations. 9. Contractors in this proceeding shall not require Contractors to submit the evidence in question. 10. The Contracting Authority, within the limits of the provisions of Article 462 et seq. of the Act, allows the Contractor to carry out the subject of the contract using subcontractors. The contractor who intends to entrust the execution of part of the contract to subcontractors shall indicate in the tender the parts of the contract which he intends to subcontract and the names of any subcontractors, if already known. 11. Reasons for applying the criterion price 80% - Quality requirements referred to in Article 246(2) of the Act, The Contracting Authority shall describe in detail in the model of the Agreement together with the Annexes.
