Air control and data processing of FRISS systems at military airports (2027-2029)

Data necessary for assessing suitability and required method of verification: GP1.) The Candidate shall, pursuant to Section 48 (1) (a) of the Hungarian Public Procurement Act (Vbt.), submit a declaration from all of its account-keeping financial institutions with the following content: • since when it has been maintaining the Candidate's payment account (specifying the year, month, and day for each account), • indication of payment account numbers, • whether it meets its payment obligations on time, • whether any queuing of payment orders exceeding 30 days has occurred on its payment account within the 12 months prior to the dispatch of the contract notice. By 'queuing of payment orders', the Contracting Authority means the transaction defined in Section 2, Point 25 of Act LXXXV of 2009 on the Provision of Payment Services. Minimum level(s) of suitability required: (if applicable) GP1.) The Candidate is deemed unsuitable if, based on the declaration issued by the financial institution maintaining its payment account, queuing of payment orders exceeding 30 days occurred on any of its payment accounts within the 12 months prior to the dispatch of the contract notice. The dispatch date of the contract notice is the 'Date of dispatch of this notice'. Pursuant to Section 50 (4) of the Vbt., the Contracting Authority draws the Candidate's attention to the fact that joint candidates may also jointly fulfill the prescribed suitability requirements. For requirements that, by their nature, can only apply to economic operators individually, under the possibility of joint compliance, it is sufficient if one of them fulfills it. Pursuant to Section 50 (5) of the Vbt., the Contracting Authority draws the Candidate's attention to the fact that candidates may also fulfill the prescribed suitability requirements by relying on the capacities of any other organization or person, regardless of the legal nature of the relationship between them. In this case, this person or organization must be indicated in the request to participate, specifying the relevant section of the contract notice and the suitability requirement(s) for the proof of which the candidate relies on the resources of that organization. Pursuant to Section 50 (7) of the Vbt., the organization whose data the candidate uses to certify economic and financial standing shall be liable as a guarantor pursuant to Section 6:419 of the Hungarian Civil Code (Ptk.) for compensating damages incurred by the contracting authority in connection with non-performance or defective performance by the tenderer.

Information and formalities necessary for evaluating if the requirements are met: MSZ1.) Pursuant to Section 49 (2) point f) of the Vbt., the Applicant shall submit a recognized ISO 9001:2015 certificate (collection and evaluation of data measured during aerial inspection), or a valid certificate of its quality management system according to an equivalent standard, issued by an independent body accredited in any national system, or a simple copy thereof, or other evidence of its equivalent quality management system. MSZ1.) An Applicant shall be deemed unsuitable if it does not possess an ISO 9001:2015 certificate or a certificate according to an equivalent standard tailored to the subject-matter of the procurement (collection and evaluation of data measured during aerial inspection), issued by an independent body accredited in any national system, or other evidence of its equivalent quality management system. The Contracting Authority shall accept as certification equivalent to the ISO 9001:2015 standard and as other equivalent evidence of the quality management system, in particular but not exclusively, certification aligned with the subject-matter of the procurement from a body accredited in any national system, provided that: – it is a sector-specific standard of ISO 9001, or – it is based on an internationally recognized quality management standard (for example, TL 9000 Quality Management System (QMS)), or – it is an AQAP 2110 or AQAP 2120 quality management system certificate/attestation established on the basis of military requirements and issued by a certification body notified by law or by a government quality assurance organization of a NATO member state, or – it is a certificate/confirmation issued by an accredited certification body or a body notified by law that the audit has been performed by the designated auditor(s), no non-conformity was found, and the issuance of the certificate (attestation) is in progress.

Information and formalities necessary for evaluating if the requirements are met: MSZ2.) Taking into account point a) of Section 49 (2) of the Vbt., the Candidate shall present its references regarding the contractual performance of services matching the subject-matter of the procurement (flight inspection of airport navigation or landing or lighting equipment) completed in the 3 years (36 months) preceding the dispatch of the contract notice. The certificate/declaration must contain at least the following: - the subject matter of the contract in such a manner that compliance with the minimum suitability requirements can be clearly determined; - the volume/quantity of the contract; - the place of performance; - the date/period of contractual performance ('commencement and completion from - to' year, month, day); - the name and address of the other contracting party; - furthermore, it is necessary to declare whether performance was carried out in accordance with the regulations and the contract. Minimum suitability requirement(s): (where applicable) MSZ2.) A Candidate is unsuitable if it does not possess a reference regarding the contractual performance of services matching the subject-matter of the procurement (flight inspection of airport navigation or landing or lighting equipment) with a value of at least net HUF 50,000,000, completed in the 3 years (36 months) preceding the dispatch of the call for competition. Required method of proof: Pursuant to Section 49 (4) of the Vbt.: a) if the other contracting party is an organisation qualifying as a contracting authority under this Act, by a certificate issued by it, or b) if the other contracting party is an organisation other than those specified in point a), by a certificate issued by it or by a declaration of the tenderer/candidate. Pursuant to Section 49 (5) of the Vbt., if the Candidate, for any legitimate reason, is unable to submit the documents required by the Contracting Authority, it may verify its technical or professional suitability by any other document deemed appropriate by the Contracting Authority. The candidate concerned is obliged to substantiate, when requesting additional information, the reason why it is unable to submit the prescribed documents and to request information on the method of proving suitability accepted by the Contracting Authority instead of the given suitability requirement and method of proof. Pursuant to Section 50 (4) of the Vbt., the Contracting Authority draws the Candidate's attention to the fact that candidates participating jointly may jointly satisfy the prescribed suitability requirements. Pursuant to Section 50 (5) of the Vbt., the Contracting Authority draws the Candidate's attention to the fact that candidates may also meet the prescribed suitability requirements by relying on the capacities of any other organisation or person, regardless of the legal nature of the links between them. In this case, this person or organisation must be indicated in the request to participate, specifying the relevant point of the call for competition and the suitability requirement(s) for the verification of which the candidate relies on the resources of this organisation. Pursuant to Section 50 (6) of the Vbt., the request to participate must include a document containing a contractual commitment—or, where applicable, a commitment undertaken in a preliminary contract—from the organisation placing its capacities at disposal, proving that the resources necessary for the performance of the contract will be available throughout the duration of contract performance.

The information required for the assessment of suitability and the required certification method: MSZ3) The applicant shall include a valid certificate or copy of the quality management system of AQAP 2110: 2016 according to Article 49 (2) (f) of Vbt. MSZ3) AQAP 2110: 2016 NATO normative document quality management system is legally certified by a certification organisation or a valid certificate / certificate from a NATO government quality assurance organisation if it does not have the same procurement subject (7120 '08 Technical examination, analysis). Pursuant to Article 49 (5) of the Vbt., if, for any legitimate reason, the applicant is unable to submit the documents required by the applicant, he may demonstrate his technical or professional competence by any other document deemed appropriate by the applicant. When requesting additional information, the applicant concerned shall provide evidence of the reasons for which he is unable to submit the required documents and request information on the manner in which the certificate of competence was accepted by the contracting authority instead of the relevant competence requirement and the means of certification. The applicant shall, pursuant to Article 50 (4) of the Vbt., draw his / her attention to the fact that the required competence requirements may be met jointly by candidates. The applicant shall, pursuant to Article 50 (5) of the Vbt., draw his / her attention to the fact that the required competence requirements may be met by candidates on the basis of the capacity of any other organisation or person, irrespective of the legal nature of the relationship between them. In that case, the applicant shall indicate in the application that person or entity and, by indicating the relevant point of the invitation to initiate the procedure, the competence requirement, the requirements for which it relies on the resources of that organisation in order to justify it. Pursuant to Article 50 (6) of the Vbt., a document containing the contractual commitment of the entity making its capacity available in the application to perform the contract, if applicable, shall be attached to the application to confirm that the resources necessary for the performance of the contract will be available during the performance of the contract.
