Appendix 11 - References (with the offer); No formal requirement or otherwise:

Proof of qualification and authorisation to pursue the profession in accordance with the legislation of the country of the Community or of the Contracting State of the EEA Agreement (extract from the commercial register) (with the offer; by means of a third-party declaration):

Proof of an existing professional or company liability insurance cover (with the offer; by means of a third-party declaration):

Competence and permission to pursue the profession - Tenderers must prove their competence and permission to pursue the profession, in accordance with the legislation of the State in which they are established, either by registering in a professional or commercial register of that State or by other means (to be submitted to a group of tenderers for each member). The proof shall not be older than 12 months from the contract notice.

Economic and financial capacity - proof of professional or company liability insurance for the performance of the advertised contract (to be presented for each member in the case of bidding associations) by submitting a confirmation of the insurance at least in copy (not older than 12 months). Minimum Condition: Minimum amounts of cover of the professional and company liability insurance for personal and material damage in the amount of 2.5 million.

Euro and asset losses of 0.2 million Euro (maximised at least twice per year). Alternatively: Submission of a self-declaration that in the case of an order, the existing cover sums are adjusted to the sums listed above. The proof of the adjusted insurance cover must be submitted at the latest before the start of the service provision.

Technical and professional capacity - Tenderers must prove their technical and professional capacity by providing appropriate references on previously executed supply and service contracts. Each reference must be provided with the delivery period and the recipient (company name and named contact person as well as his telephone number or e-mail address). The references shall be attached to the tender with Appendix 11.

Minimum conditions: At least one (1) comparable reference from the last maximum of three years is required. The tenderer shall be responsible for proving comparability. This must explain the references given in a meaningful way in relation to the criteria for reference suitability given. Each reference must include the rental of a Darkfiber incl. of a support contract already existing for 3 years.
