Delivery of a computing server with GPU accelerators for artificial intelligence applications

1. The subject of the contract is the delivery of a computing server with GPU accelerators for artificial intelligence applications – 1 unit. 2. The server (hereinafter referred to as the "Device") is intended for local (on-premise) execution, fine-tuning, and inference of generative artificial intelligence models, in particular generative models for image and video creation (text-to-image, image-to-image, text-to-video, image-to-video). The Device will be used for simultaneously loading models with significant GPU memory requirements (models requiring at least 80 GB VRAM) as well as for processing training data and storing model checkpoints. 3. The detailed description of the subject of the contract and the description of the Contracting Authority's requirements regarding performance and acceptance are defined by: 1) the description of the subject of the contract (hereinafter "OPZ") – Annex No. 1 to the SWZ (Tender Specifications), 2) the draft contractual provisions (hereinafter "PPU") – Annex No. 2 to the SWZ. 4. All requirements set forth in the documents indicated above constitute minimum requirements, and meeting them is mandatory. 5. The Contracting Authority requires that: 1) the server and all computer components comprising it are brand new, unused, technically operational, safe, complete, and ready for operation; 2) the server is covered by manufacturer support from the date of signing the final acceptance protocol for the contract performance, at least until the expiration date of the granted warranty for the entirety of the subject of the contract. By manufacturer support, the Contracting Authority understands services provided by the server manufacturer or an entity authorized by it, under which the Contracting Authority, throughout the entire duration of its validity, will be able to download and install free of charge any security patches (fixes), as well as software updates (including firmware updates); 3) the delivered server is equipped with complete cabling provided by the manufacturer to ensure its proper operation; 4) the server was manufactured no earlier than 6 months prior to the delivery date and was not previously assigned to any user; 5) the server originates from an official, authorized manufacturer distribution channel within the EU and was delivered in original, undamaged manufacturer packaging. 6. In terms of the IT security of the delivered server, the Contractor is obliged to execute the subject of the contract in a manner ensuring the security, interoperability, and manageability of the server in the Contracting Authority's IT environment. Rack mounting of the server, connecting it to the Contracting Authority's network, and production commissioning are performed by the Contracting Authority independently (cf. Section III.5, item 5). The Contractor is obliged to cooperate with representatives of the Contracting Authority responsible for IT infrastructure and cybersecurity to the extent necessary to carry out the server acceptance. The detailed obligations of the Contractor in this scope and sanctions for their breach are set forth in §3 of the PPU. 7. WARRANTY: 1) The Contracting Authority requires that the subject of the contract – the server – be covered by a manufacturer's quality warranty including service support provided by the manufacturer or a service partner authorized by the manufacturer within the territory of the Republic of Poland, for a period not shorter than specified in the OPZ (minimum 36 months from the date of signing the Final Acceptance Protocol), 2) the manufacturer's warranty referred to in item 1 shall be provided with a Next Business Day service response time, on-site, and with a Keep Your Drive (or equivalent) service for defective storage media to remain with the Contracting Authority, 3) detailed warranty conditions are specified in the draft contractual provisions (§6 PPU), 4) if the standard manufacturer warranty period begins before the date of final acceptance…
