Delivery of computer servers for the Information Centre of the University of Gdańsk with the right of options.

1. The subject of the contract is the delivery of computer servers, hereinafter referred to as the "equipment", for the IT Centre of the University of Gdańsk, with the right of option. 2. The contract includes the delivery of computing servers in the following quantities: 1) for the basic contract: 3 units, 2) for the contract covered by the right of option: a maximum of 3 units. 3. Common Procurement Vocabulary (CPV) Classification Code: 48822000-6 (computer servers). 4. The Contracting Authority has the option to exercise the right of option, consisting in increasing the quantity of equipment ordered under the basic contract, under the terms and according to the procedure described below: 1) The Contracting Authority may, within 14 days from the date of concluding the contract, submit to the Contractor orders covered by the right of option, specifying the quantity and type of equipment indicated in the tender form – Annex No. 1 to the SWZ (Terms of Reference), subject to not exceeding the maximum scope of the right of option specified in that annex, 2) submission to the Contractor of an order covered by the right of option by the authorized Representative of the Contracting Authority, referred to in § 12 sec. 1 item 2, in the manner specified in § 6 sec. 4 of the draft contract – Annex No. 4 to the SWZ, constitutes the exercise by the Contracting Authority of the right of option in terms of the quantity and type of equipment indicated in that order, 3) The Contracting Authority may exercise the right of option once or multiple times by placing subsequent orders covering selected quantities and types of equipment, until the maximum scope of the right of option specified in the tender form – Annex No. 1 to the contract is exhausted, however no later than within the deadline referred to in item 1, 4) the value of the equipment ordered under the right of option will be consistent with the unit prices indicated by the Contractor in the tender form – Annex No. 1 to the SWZ, 5) the delivery time for each order covered by the right of option: up to 30 days from the date the Contracting Authority places the order covered by the right of option, 6) exercising the right of option does not constitute an amendment to the contract. The Contractor is not entitled to any claim against the Contracting Authority for the Contracting Authority's failure to exercise the right of option in whole or in part. The decision to exercise the right of option, including its scope, is the unilateral right of the Contracting Authority, 7) the provisions of the draft contract – Annex No. 4 to the SWZ concerning the basic contract shall apply accordingly to orders covered by the right of option, unless provided otherwise. 5. A detailed description of the subject of the contract is set out in Annex No. 5 to the SWZ – description of the subject of the contract. 6. Place of delivery of the equipment: IT Centre of the University of Gdańsk, ul. prof. Marii Janion 7, 80-309 Gdańsk. 7. The Contracting Authority requires a warranty on the equipment for a period of 36 months. Details regarding the warranty are contained in § 7 of the draft contract – Annex No. 4 to the SWZ. 8. In the description of the subject of the contract, constituting Annex No. 5 to the SWZ, the Contracting Authority described the requirements for management systems relating to the production process of the offered equipment by referring to the standards indicated in item No. 14 of Table 1 of the description of the subject of the contract. In every case where these standards are indicated in the text of the SWZ, including in the annexes to the SWZ, it should be understood that such indication is accompanied by the words "or equivalent".
