Delivery of computing servers for the Information Centre of the University of Gdańsk with the right of options.

1. The subject of the order is the delivery of computational servers, hereinafter referred to as ‘the equipment’, for the Information Centre of the University of Gdańsk with the right of option: 2. Common Procurement Dictionary Classification Code (CPV): 48822000-6 (computer servers). 3. The order includes the delivery of computing servers in quantities: 1) for the basic order: server A – 1 pc, server B – 1 pc, 2) for the order covered by the legal option: server A – up to 1 pc, server B – up to 1 pc. 4. The Contracting Authority shall be able to exercise the option of increasing the quantity of equipment ordered under the basic contract, in accordance with the following rules and in accordance with the procedure described below: 1) The Contracting Authority provides for the possibility of ordering the Contractor under the option right, within the period of performance of the basic contract referred to in paragraph 1 of Chapter IV, by submitting by electronic means an appropriate declaration of will to the Contractor, including the determination of the quantity and type of equipment indicated by the Contractor in the tender form — Annex 1 to the SWZ, 2) the value of the equipment ordered under the option right will be consistent with the unit prices indicated by the Contractor in the tender form — Annex 1 to the SWZ, 3) the time limit for the performance of the contract covered by the option: up to 90 days after the Contracting Authority has placed the option, 4) the exercise of the option right does not constitute a change of contract. The Contractor shall not be entitled to any claim against the Contracting Authority if the Contracting Authority does not exercise the option right. The decision to implement a contract covered by a legal option constitutes a unilateral right of the Contracting Authority, 5) the provisions of the draft contract — Annex 5 to the SWI concerning the basic contract shall apply to the contract covered by the legal option, unless otherwise reserved. 5. The detailed description of the subject matter of the contract is set out in Annex 6 to the SWZ – Description of the subject matter of the contract. 6. Place of delivery of equipment: Information Centre of the University of Gdańsk, ul. Prof. Maria Janion 7, 80-309 Gdańsk. 7. The purchaser requires a warranty on the equipment for 36 months. The details of the guarantee are set out in § 7 of the Project Agreement – Annex 5 to the SWI. 8. In the description of the subject matter of the contract, as set out in Annex 6 to the EGM, The Contracting Authority has described the requirements for management systems relating to the production process of the equipment offered by reference to the standards indicated in items 14 of Tables 1 and 2 of the description of the object of the contract. Whenever those standards are indicated in the content of the WWZ, including the Annexes to the WWZ, it shall be understood that the words ‘or equivalent’ are accompanied by such indications. Thus, the Contracting Authority shall allow solutions equivalent to those indicated in items 14 of Tables 1 and 2 of the description of the subject-matter of the contract in accordance with Article 101(4) and (5) of the Public Procurement Law. The concept of equivalence should be understood to mean that the equipment offered comes from the production covered by the implemented and current management system, which meets equally the requirements set out in items 14 of Tables 1 and 2 of the description of the subject matter of the contract. The equivalent solutions used must correspond to their type and scope of purpose for which the standards referred to in items 14 of Tables 1 and 2 of the description of the object of the contract are used. 9.
