1. Lot 1

   1) The subject of the order is the delivery of servers (2 pcs), as defined in Annex 2 to the WWZ, hereinafter referred to as ‘the equipment’. The equipment offered must be brand-new and unused, coming from the current production (year of production: not earlier than 2025), have appropriate certificates allowing it to be sold and used in Poland. The contractor is obliged to provide free warranty service for the equipment. 2) The scope of the contract includes: purchase and delivery of equipment to the premises of the Contracting Authority with unloading, transfer to the place designated by the Contracting Authority. 3) A detailed description of the subject matter of the contract is given in Annex 2 to the WWZ. 4) Required term of completion: up to 5 weeks from the date of receipt of the contract. The Contractor may shorten the time limit for performance of the contract in relation to the required time limit indicated above. The tender providing for a shorter deadline will receive points in the evaluation of tenders using the selection criterion of the most advantageous tender. 5) Delivery address: University of Silesia in Katowice, Information Service Department of Toku Studies, ul. Bankowa 14, 40-007 Katowice 6) Minimum warranty period required for the manufacturer: 60 months from the date of signature of the collection protocol. 7) Service response time required: at the latest on the next working day after the defect report (NBD). 8. The detailed conditions for the performance of the contract and the conditions for payment shall include the model contract annexed to the WWZ. 9. Amendments to the provisions of the Agreement in relation to the content of the tender on the basis of which the Contractor was selected, resulting from the disposal of Article 455(1) of the PZp Act, may be made in the circumstances provided for in paragraph 10(2) of the model contract (Annex 3 to the SWI) (10) The contractor can only make one offer in ninja proceedings. 11. The Contracting Authority shall require that the provision offered, including all ICT products, ICT services and ICT processes used for the performance of the contract, both as principal elements and components, elements of the service environment or ancillary solutions, does not include: - ICT products, ICT services or ICT processes identified in the recommendation referred to in Article 33(4) of the Law of 5 July 2018 on the national cybersecurity system, stating their negative impact on the essential interest of the security of the State; - the ICT product of which the type is defined in the decision to recognise the supplier as a high risk provider referred to in Article 67b(15) of the Law of 5 July 2018 on the national cybersecurity system, or the ICT services or ICT processes specified in that decision. Failure to comply with this requirement will result in rejection of the tender, respectively, on the basis of Article 226(1), point 17 or point 19 of the Public Procurement Law.

2. Lot 2Delivery of servers

   1) Przedmiotem zamówienia jest dostawa serwerów (2 szt.), określonych w załączniku nr 2 do SWZ, zwanych dalej „sprzętem”. Oferowany sprzęt musi być fabrycznie nowy i nieużywany, pochodzić z bieżącej produkcji (rok produkcji: nie wcześniej niż 2025), posiadać stosowne certyfikaty dopuszczające go do sprzedaży i użytkowania na terenie RP. Wykonawca jest zobowiązany zapewnić bezpłatny serwis gwarancyjny sprzętu. 2) Zakres zamówienia obejmuje: zakup i dostarczenie sprzętu do siedziby Zamawiającego wraz z rozładunkiem, wniesieniem do miejsca wskazanego przez Zamawiającego.. 3) Szczegółowy opis przedmiotu zamówienia stanowi załącznik nr 2 do SWZ. 4) Wymagany termin realizacji zamówienia: do 5 tygodni od daty otrzymania zamówienia. Wykonawca może skrócić termin realizacji zamówienia w stosunku do wymaganego terminu wskazanego powyżej. Oferta przewidująca skrócenie terminu realizacji otrzyma punkty w ramach oceny ofert z zastosowaniem kryterium wyboru oferty najkorzystniejszej. 5) Adres dostawy: Uniwersytet Śląski w Katowicach, Dział Informatycznej Obsługi Toku Studiów, ul. Bankowa 14, 40-007 Katowice 6) Wymagany minimalny termin gwarancji producenta: 60 miesięcy licząc od daty podpisania protokołu odbioru. 7) Wymagany czas reakcji serwisu: najpóźniej w następnym dniu roboczym od zgłoszenia wady (NBD). 8) Szczegółowe warunki realizacji zamówienia oraz warunki płatności zawiera wzór umowy stanowiący załącznik nr 3 do SWZ. 9) Zmiany postanowień zawartej Umowy w stosunku do treści oferty, na podstawie której dokonano wyboru Wykonawcy, wynikające z dyspozycji art. 455 ust. 1 pkt 1) ustawy Pzp, mogą nastąpić w okolicznościach przewidzianych w par. 10 ust. 2 wzoru umowy (załącznik nr 3 do SWZ) 10) Wykonawca może złożyć tylko jedną ofertę w ninjeszym postępowaniu. 11) Zamawiający wymaga, aby oferowane świadczenie, w tym wszystkie produkty ICT, usługi ICT oraz procesy ICT wykorzystywane do realizacji zamówienia, zarówno jako elementy główne, jak i komponenty, elementy środowiska świadczenia usługi lub rozwiązania towarzyszące, nie obejmowało: - produktów ICT, usług ICT lub procesów ICT wskazanych w rekomendacji, o której mowa w art. 33 ust. 4 ustawy z 5 lipca 2018 r. o krajowym systemie cyberbezpieczeństwa, stwierdzającej ich negatywny wpływ na podstawowy interes bezpieczeństwa państwa; - produktu ICT, którego typ został określony w decyzji w sprawie uznania dostawcy za dostawcę wysokiego ryzyka, o której mowa w art. 67b ust. 15 ustawy z 5 lipca 2018 r. o krajowym systemie cyberbezpieczeństwa, ani usług ICT lub procesów ICT określonych w tej decyzji. Niespełnienie powyższego wymagania będzie skutkować odrzuceniem oferty odpowiednio na podstawie przepisu art. 226 ust. 1 pkt 17 albo pkt 19 ustawy Pzp.
