Warunek udziału w postępowaniu dotyczący uprawnień do prowadzenia działalności gospodarczej zostanie spełniony, jeżeli Wykonawca wykaże, że jest wpisany do rejestru podmiotów szkolących, prowadzonego przez Prezesa Urzędu Lotnictwa Cywilnego, zgodnie z art. 95a ustawy z dnia 3 lipca 2002 r. – Prawo lotnicze (Dz. U. z 2025 r. poz. 1431).
  2. Warunek udziału w postępowaniu dotyczący zdolności zawodowej w zakresie doświadczenia Wykonawcy zostanie spełniony, jeżeli Wykonawca wykaże, że w okresie ostatnich 3 lat, licząc wstecz od dnia, w którym upływa termin składania ofert, a jeżeli okres prowadzenia działalności jest krótszy – w tym okresie, wykonał:
  1. jeżeli Wykonawca składa ofertę w części nr 1 zamówienia:
    1. co najmniej dwie dostawy Bezzałogowych Statków Powietrznych o wartości nie mniejszej niż 80000 PLN (osiemdziesiąt tysięcy) brutto każda oraz
    2. co najmniej dwie usługi przeprowadzenia szkoleń na pilotów Bezzałogowych Statków Powietrznych, składające się z części teoretycznej i praktycznej dla co najmniej 50 uczestników każda;
  2. jeżeli Wykonawca składa ofertę w części nr 2 zamówienia:
    1. jedną dostawę Bezzałogowych Statków Powietrznych o wartości nie mniejszej niż 20000 PLN (dwadzieścia tysięcy złotych) oraz
    2. co najmniej dwa szkolenia na pilotów Bezzałogowych Statków Powietrznych, składające się z części teoretycznej i praktycznej dla co najmniej 8 uczestników każde.Uwaga 1: Jeżeli wartość dostawy jest wyrażona w walucie innej niż PLN, w celu oceny spełniania ww. warunku udziału w postępowaniu, Zamawiający przeliczy podaną wartość na PLN według średniego kursu Narodowego Banku Polskiego obowiązującego w dniu publikacji ogłoszenia o zamówieniu w Biuletynie Zamówień Publicznych, a jeżeli w tym dniu nie publikowano kursu tej waluty – według ostatniego średniego kursu Narodowego Banku Polskiego przed dniem publikacji ogłoszenia o zamówieniu w Biuletynie Zamówień Publicznych.Uwaga 2: Wykonawca może wykazać te same dostawy lub usługi w celu potwierdzenia spełniania warunku udziału w postępowaniu dotyczącego zdolności zawodowej w dwóch częściach zamówienia.
  3. W przypadku Wykonawców wspólnie ubiegających się o zamówienie:
  1. warunek udziału w postępowaniu dotyczący uprawnień do prowadzenia działalności gospodarczej zostanie spełniony, jeżeli co najmniej jeden z Wykonawców wspólnie ubiegających się o udzielenie zamówienia jest wpisany do rejestru podmiotów szkolących, prowadzonego przez Prezesa Urzędu Lotnictwa Cywilnego, zgodnie z art. 95a ustawy z dnia 3 lipca 2002 r. – Prawo lotnicze i zrealizuje usługi szkolenia, do których realizacji te uprawnienia są wymagane;
  2. warunek udziału w postępowaniu dotyczący zdolności zawodowej w zakresie doświadczenia musi spełniać w całości jeden z Wykonawców wspólnie ubiegających się o zamówienie albo w całości podmiot udostępniający Wykonawcom wspólnie ubiegającym się o zamówienie zasoby w postaci doświadczenia. Zamawiający nie dopuszcza tzw. sumowania doświadczenia;
  3. W odniesieniu do warunku dotyczącego doświadczenia Wykonawcy wspólnie ubiegający się o udzielenie zamówienia mogą polegać na zdolnościach tych z Wykonawców, którzy wykonają usługi, do realizacji których te zdolności są wymagane. Wykonawcy wspólnie ubiegający się o udzielenie zamówienia dołączają do oferty oświadczenie, stanowiące załącznik nr 3 do SWZ, z którego musi wynikać, które usługi wykonają poszczególni Wykonawcy.
